• To change name on Indian Passport without divorce/marriage/death

Hi, I am an Indian passport holder living in the US and a green card holder. After marrying in the US I took my spouse's last name, but now I want to change my last name to my father's last name. I have gotten a Name Change Court Order signed by the judge in my county. Now I am looking for a lawyer to help me change my name on my Indian Passport.

To endorse the spouse's name on your passport, you have to apply for a 'Re-issue' of passport and get the specified change done in personal particulars. To check the complete list of documents to be submitted along with the application form. 

No additional document is required for deletion of spouse's name on account of divorce/separation.

- If you have court order for changing the name , then no other formalities are required .

- Apply for re-issue the passport online and submit the said order of the court with the copy of the existing passport .

1. You shall have to execute an affidavit before a 1st Class Judicial Magistrate affirming that you want to be called and named and known  in  your maiden name.

 

2. After executing the affidavit, you shall have to publixh the same in two local News papers, one being in vernacular and also in local Gazette.

1. On the basis of an order passed by a court in US you cannot have the name changed in your Indian passport. Indian authorities will not execute the US court order.

2. You need an order from the competent court in India.

Dear Ma'am,

1. The process of re-issue of passport is to be undertaken

 2. and since there is no case of separation/divorce/ death an affidavit must be produced by an Indian court  regarding the change in name  of the passport holder along with other relevant documents

3. After execution of such affidavit, the same should be published in 2 newspapers i.e Official Gazette  and local vernacular newspaper
