• Some investments asked to hide

Hi,

I am having divorce case along with Maintenance Case. For maintenance Cases, I was asked to submit asset and Liabilities. I have submitted all details such as my salary slip, FDs, assets details, Car Loan , Home Loan. But my Lawyer asked me to hide NPS,PPF and mutual fund. For NPS I have 77 k, PPF , I have 1,80K and Mutual Fund, I have 1,50 k. The total amount is 4 lakhs. Is it ok to hide these details. As I can see in the declaimer form which needs to be signed by me. Is it going to be a problem for me.

You should show these investments. Otherwise if she knows and states this you could be in trouble.

All the details of investment is in statutory  bodies. The details of which can  be had through direction of Court. If is established that you have sworn  a false affidavit, your credibility will be totally demolished before the court and you can prosecuted for filing  false affidavit. Any such concealment of facts is risky. Avoid such risks.

Dear Sir,

1) Ask your lawyer what reason is there to hide them

2) Hiding your investment and providing false affidavits can acquire legal trouble for you.

3) if your wife finds out or court finds out the same perjury charges and enquiry, can be initiated by court.

4) it is thus not in your interest to hide such details.

- If your wife is knowing about your fund details , then you cannot hide the said details from the court , otherwise she can challenge the same , and also can file  compliant under section 340 CrPc against you . 

- Hence you should not conceal the true facts from the court.

You can decide about the disclosure of details pertaining to your assets.

Actually in an affidavit you may have to reveal the facts pertaining to all your assets, you are not supposed to suppress any information because if any information has been found to have been suppressed at a later stage then there are chances for contempt of court action also against you.

If you hide the responsibility will revealed is on you. So think about it. As per the SC judgement you need to reveal the income vide an affidavit so it will be false statement if you hide the same
