• Drunk and drive in Hyderabad - reading of 58 - first time offence

I rarely drink and when I do I always take a cab. On this day - I had gone out with a friend using a cab after parking the car at place close to my home. I returned in a cab as well , the mistake that i made was thinking that i could drive from the parked spot to my home 1.5 kms away since i was feeling fine and that the cab would take time to come. I was asked to undergo a breathanalyser test near Q City in Gachibowli after driving for 300m which gave a reading of 58. This was my first time. My car has been seized, the PS is saying there will be case and I am really worried and do not want to face a jail of even 1 day since that may jeopardize my career. Should i hire a lawyer ?

You will just have to pay fine as this is your first offence

You need to engage an Advocate  as this is first time you are caught, you will end up paying fine up to 10K.  jail term is unlikely.

- As per rule in Hyderabad , for 1st offence and reading below 150 chances of getting jail is less or nil but for second offence it will be 100% sure .

- Since, it was your first offence , and reading was only 58 , then you may filed and no jail .

- Approach an advocate for getting your impounded car after payment of some fines.

Hi, Don't bother much, you need to pay the fine and plead guilty for the offence before the Court, there ends the matter.

Since this is first offence of this sort, you will be let off by court after you are paying the fine amount imposed by court.

The offence of this sort committed for first time would not appear in the police records which are essential for police clearance certificate for the purposes of visa or employment.
