• Converting 11B Plot (5 Gunta) to form 9 Khata

For this plot , layout approval authority is Gram panchayat and Taluk Panchayat. Location of the plot is in rural part out side the pattan panchayat area of Taluk headquarters. It is present in Siddapur Taluk Uttar Kannada district Karnataka. Big agricultural land was bifurcated into many 5 gunta plots to get different survey number for each 5 gunta( In record Agri Land at this stage ). For each 5 gunta separately Non agri ( NA) certificate was obtained by developer. NA order was obtained in 2013 . With that NA order , form 11b was obtained from gram panchayat for each plot. Later he sold approximately 20 plots ( 5 gunta each) without layout approval by gram panchayat. We purchased one. NOn agriculture conversion (NA) order copy mentions that he should sell that 5 gunta after obtaining layout plan approval. he did not follow that condition of the NA order. However registrar and gram panchayat had no problem to register plot and Issue 11b form. Gram panchayat told us that if we get layout approval from gram And Taluk panchayat they will issue form 9. Few people who purchased 5 gunta plots got form 9 after doing that process and now constructing home. Our concern is developer did not follow one condition of the NA order , he sold before layout approval for each 5 gunta area . Now if we get layout approval and get form 9 from gram panchayat will that legal mistake done by the developer is nullified ? Will that mistake affect us in future? Will that mistake affect the validity of the NA order in future ? Will that affect the compensation you get if government plans any project in that location in future ?
No problem with ownership documents with that land. 
As per 2014 order Gram and taluk panchayat can approve 1 acre or less size layout.

All your concerns are unfounded. Approval of layout/sanction plan nullifies all irregularities. Once approved, approved for ever. No problem will arise in future. NA cannot be reversed. If any project is planned and land acquired you will get full compensation under Right to Fare Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Compensation cannot be deprived on the ground of any irregularity. Your title is perfect. GP  and TP at their level can approve layout.

If the gram panchayat has agreed to regularize the approval of layout at this stage by collecting penalty,  you may better get the approval now also. 

This would solve your problems that may arise in future in this regard.

Hi,  now you can't get a chance to approve the layout. The Gram Panchayath or Taluk panchayath has no authority to issue layout plan. The town and country planning authority has authorise to issue layout plan.

Dear sir/ma'am,

 

As you have already received the form 9 for the property, there is very little chance that you will face legal issues in the future. You can apply for form 11 at the gram panchayat as soon as possible and the conversion of the land from agricultural to non- agriculture will be irreversible. There is no reason to worry once the approval is confirmed. Even if there is a penalty, you can pay it and get the approval. Thank you.
