• A woman is making false allegations against me

A woman who happened to be my best friend has made false allegations against me. The allegations say that I have blackmailed her via email for explicit photos. I haven't.

She wrote an application to the police 2 years back. Police called me for investigation but that's about it. The application was closed 2 years back.

I haven't been in contact with her since 2 years.

Now she has made the same complaint to my company and the company has hired private investigator to investigate the complaint. The company has also put my promotion on hold since a month and I'm losing a lot of money.

I made an application to the police against her for defamation but police said they can't do anything and asked me to go to court.

The company is leaning on her side of the story. I didn't know why but then I checked her police report recently and it has a lot of screenshots where she has talked to me but I don't recall any of these chats. They appear very real and has my name on it. These could be fabricated or there is an imposter. I don't know.

The company seems to be taking these screenshots on face value and is stopping my promotion, and banning me from attending future company events for few years. I can only attend again after few years after I give them character references from people proving that I contributed meaningfully to the community and that I had no such incident for 2-3 years.

Current status -
- I'm waiting for the private investigator to ask me questions, no one has asked me anything yet but all the communication from company is telling me that they are inclined to believe this woman.
- I'm planning on leaving the company as well since I have offer from another company BUT I'm worried about two things:

1. This woman could attack me again by making false allegations to the new company
2. My current company might reveal details of this complaint to the new company
3. This woman might publicly defame me in the future affecting my employment with the new company

Dear sir/ma'am,

It is a serious issue, you should not wait till the investigation is over rather send her a legal notice and file a case against her. Since the SCREEN SHOTS can easily be fabricated, after filing a complaint, her phone and emails will be checked by the court as these can not be fabricated and can be traced by the cyber experts even though it has been deleted. 

If you think those chats were not done by you, you need to stay positive and take action against it.

you can file an FIR against the lady for defamation, cheating, criminal breach of trust, misrepresentation, fabrication of evidences, producing fake evidenced, and she will be liable for punishment under IPC .

You can talk to that woman and request her to withdraw her complaint and to save your future.

Or if you have documentary evidences to challenge her false complaint you can drag her to  court with a criminal complaint and file a defamation case against her

Check if you can avoid this problem by switching place or not. Check probability. 

If chances are more that she will trouble you then leave hideout and confront her.

1) issue legal notice to lady to withdraw false and defamatory statements made against you and to render an unconditional apology 

 

2) if she refuses file complaint of criminal defamation against her under section 500 of IPC 

 

3) also file civil suit for damages against lady

Hi, She can't file a same complaint again after two years. Further, your company has no business to investigate the matter which is private affairs and they have no authority to withhold your promotions. It is better you can lodge police complaint against her.

- Since, her last compliant was closed without action legal action , then you can submit a reply to your existing company after submitting a report from the police official . 

- Further , if police refused to give you report of the compliant , then you should lodge a compliant against her blackmailing with the police and higher official . 

- Further, if no action taken place, then file a compliant before the court/magistrate for getting a status report , and to file an FIR against her. 

- Further, submit the same to your company to remove your hurdle. 

- Further, you can also file a defamation case against her as well.
