• Change of date DOB in Passport

When my son was born in 1996 we have included his date of birth 09/01/1996 in his mothers passport, as per rule of that period.we were staying abroad then.
Then in 1998 he had been issued a new passport as rule changed with same date dob.
When we came back in 2000, we observed that my son is mildly mentally reterded.so with some connection in kolkata corporation we have changed his dob. we have issued another birth certioficate from kolkata corporation to 09/01/1997, so that we could admit him to main strem studies, instead of special learning.
His passport is last reissued in 2012 as child passport, that expired in 2014.till date we have not applied for adult passport for him. all his documents including aadhar, voter card, pan card, scool/college certificate, bank details etc are containing dob of 09/01/1997.
How to apply for an adult new passport with new dob? either i have to apply for a new passport withoout informing that he was having a child passport, but that will be a serious crime. or.......what is the way out??? 
For your information, finger print was taken during reissue of his child passport in 2012.

For renewal of passport you have to disclose earlier issue of passport 

 

2) suppression of material facts is an offence and penalty can be imposed upon you 

 

3) Section 12 of the Passport Act, 1967 deals with Offences and Penalties and Section 12(1)(b) specifies whoever knowingly furnishes any false information or suppresses any material information with a view to obtaining a passport or travel document under this Act or without lawful authority alters or attempts to alter or causes to alter the entries made in a passport or travel document" shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to five thousand rupees or with both.

 

4) you would be issued passport with date of birth mentioned in earlier passport

- Since your sons real dob already mentioned in his mothers passport , and further a new passport was also issued with the same DOB , then legally you cannot adopt the birth certificates DOB for applying a Passport in his name , even he become a major. 

- Hence it is not advisable to make a new passport with the new DOB.

Dear sir/maam,

It is very rare that the information is printed wrong by the passport issuing authority, but if it happens the applicant can contact the passport officer and request for the change in date of birth.

To change the date/place of birth in the passport, you have to:

  1. Apply for a reissue of passport.
  2. Visit the Embassy / Consulate in person between 10 AM to 12.30 PM and seek approval before submitting the physical application to CKGS.
  3. Embassy/Consulate will annotate "CKGS to accept the application".

If the applicant was a major when his/her first passport with incorrect date of birth was issued, he/she can correct it, within five years of issue of the first passport. No change of date of birth is allowed afterwards.

As per the revised guidelines, passport issuing authorities (PIAs) have been authorised to consider request of each applicant seeking change in date of birth irrespective of the period that would have lapsed after the issue of the passport.

If the PIA (Passport Issuing authority)is satisfied with the claim based on documents submitted by the applicant, then passports with revised DOB can be issued by the authorities concerned.

"Based on genuineness of the cases, the passport issuing authorities can issue fresh passports.

The Ministry of External Affairs, which issues passports, has already sent instructions to the passport issuing authorities to accept digitally signed marriage certificates and birth certificates as valid proofs of marriage and birth respectively.

1. Your son was issued a passport in 1998 and then you got his date of birth changed.

2. The maximum you may do is apply for rectification of date of birth when new passport is applied.

3. If you apply for a new passport for him by concealing the fact that he already possessed a child passport then it will be an offence under Section 12 of Passports Act carrying an imprisonment of up to 2 years.
