• Enrolment with Bar

Hello Sir/ Ma’am, 

I got enrolled with Delhi Bar Council last year but couldn’t take the AIBE, and usually it takes place twice a year but last year it took place just once. This year too because of Covid, it will take place just once. My provisional enrolment expires next year in March ie. March, 2021. And I don’t think there will be another exam during this time. So my questions are:-
1) What if I don’t clear/appear for AIBE and my provisional enrolment expires? What will be my options then to get a license? 
2) Will I have to get enrolled again with the same State Bar to appear for the AIBE? Or will I be barred from practicing law since I was not able to clear AIBE within these two years? 
3) I don’t want to practice law right away, I am doing a small business currently, but after a few years I would like to take up practice full time. Can I get my license now and not use it for next 4-5 years? Or will I have to surrender my license till the time I am doing business? 
4) After getting my license, if I want to provide legal aid and teach law along with my business, can I do that? Basically take up law part time so as to not lose touch, can I do that?

1. If you dont qualify in the examination that you would appear in the current session, you may be given another chance to appear  in the AIBE. 

here are no restrictions on the number of times a candidate can for the All India Bar Examination and the candidates are eligible to write the AIBE  examination any number of times.

2. It will be necessary to be enrolled as an advocate with a State Bar Council.

Candidate must have the Advocate Admit Card/Enrollment Card issued by the State Bar Council.

Once enrollment will be sufficient. Candidates can appear as many times as it requires. There is no restriction on numbers of attempts.

3. If you have enrolled in the Bar council you canot take up any other employment or business, you may have to apply for suspend of licence till such time you are returning to the professional practice.

4. See the above answer, you cannot do any other business while being enrolled as a member of the Bar council until you suspend your practice/licence.

You can teach law while carrying on business 

 

2) if you are doing business you have to inform bar council about the same and you would not be entitled to practice law 

 

3) if your provisional enrolment expires you would have to enroll again

Dear Sir/Madam,

You are suggested that you will get the opportunity of appearing in next AIBE because things got out of order due to pandemic and your license will not be cancelled. For details refer, bar council rules and you are not permitted for other profession besides this.

If you do not appear or clear your All India Bar Examination within two years of your provisional enrollment with State Bar Council, your provisional enrollment will be revoked and again you will have to provisionally enroll with the State Bar Council to appear for AIBE.

1.2.As everyone who wants to be enrolled as an advocate has to clear examination conducted by BCI every year is mandatory for those who has passed out as on 2009 or thereafter then since 2011 AIBE has been conducted for the purpose so if you desire to practice as an advocate then has to clear this exam,there is no option.

3. After getting licence it is upto you whether you wants to work as an advocate or wants to engage yourself in other profession but to join other profession you have to surrender your licence.

4. You can if you can maintain the integrity of both the professions but not in one name.
