गा वि प्रा द्वारा एक मकान श्री विनोद कुमार के नाम 1685 अलॉट हुआ।1986 में उनके नाम लीज रजिस्टर हुई।1988 में मकान हमको पॉवर ऑफ अटॉर्नी दे कर दे दिया गया।तब से हम उसमे रह रहे है।2019 में हमने पॉवर ऑफ अटॉर्नी के आधार पर अपने दो लड़कों के नाम गाजियाबाद सब रजिस्ट्रार के यहां रजिस्ट्री कर दिया। गा।वि।प्रा।में वह मकान विनोद के नाम ही चड़ा है।लड़कों द्वारा अप्लाई करने पर गा वि प्रा कहता है कि P O A रजिस्टर्ड नहीं है नोटरिज्ड है।रजिस्ट्री लड़कों के नाम पर हो चुकी है। अब हमारे पास क्या क्या रास्ते है।यदि कोर्ट जाते है । मयी माह में इलाहाबाद हाईकोर्ट का एक ऑर्डर हुआ है कि नोटराइज्ड P OA होल्डर भी रजिस्ट्री कों पेपर्स पेश कर सकता है। क्या कोर्ट से हमे पहीली ही तारीख पर ऑर्डर मिल सकता है?

Ghaziabad development authority bill have to provide the counter in this case and after considering all the elements the high court may order.

Registered POA is necessary to execute sale deed 

 

2) notarised POA does not suffice 

 

3) ask seller to execute registered POA in your favour 

 

4) POA does not confer title to property

Yes you can apply POA for your son name but the original POA should be register with registrar like sale deed. You may only done notarized POA vinod kumar. So to remove vinod kumar name you should have done registered POA or sale deed to get effects of the transfer of ownership as the act.

1. पहली तारिख पर आर्डर नहीं होगा 

2. या तो आपको डिक्लेरेशन का मुकद्दमा फाइल करना होगा या फिर GDA के खिलाफ केस फाइल करना होगा,

दोनों ही सूरत में केस decide होने में लगभग 1 साल लग जाएगा

Sure....HC can issue DIRECTION to GDA for considering your claim in accordance with the order passed by HC in MAY.

It will be in first hearing.

But if dispute is much in depth, then it can take some more time.

Please show us the order of Allahabad High Court permitting Notarized GPA for execution of sale and documents. 

As per law enforcement officials and Law of Registration of documents, it is prohibited to execute documents based on Notarized GPA.

ये सही है की सेल दीड रजिस्ट्रेशन के  लिएपीओए रजिस्टर्ड होनी चाइये, पर अब सेल दीड रजिस्टर्ड हो चुकी है इसलिए वेट करो, म्युनिसिपेलिटी रिकॉर्ड में म्युटेशन बाद में भी करा सकते हो.
इस बिच पीओए को रजिस्टर करवाने की कोशिश करो

You have done a wrong thing by obtaining a POA deed only and not getting the property registered neither the POA deed registered.

However, i the principal is alive you may obtain a life certificate and also make him as a confirmation party to the sale deed to which you may execute a registered rectification deed.

Otherwise you may have to approach court with a suit for declaration of your title based on the documentary evidences and seek direction to GDA to transfer the name from Vinod to the current owner.

Actually poa requires mandatory registration. If you have such order you can show it to the sub registrar and get it done
