• Parent black mailing with suicide threat to extract money from family members

Dear Lawyer(s) Sir/Madam,
I have a father who has a habit of threatening family members with suicide attempt in order to get paid money from his children and also extended family members.
He is repeatedly in and out of jobs (so no stable income) and he is over 60 years of age.
He is staying in a house with my mother which is currently in joint ownership under my brother and my name in Chennai.
He has been following this blackmail tactic for many years to get money from both his children (including myself) and other family members (his wife's side family). He is fudging the monthly expenses (such as electricity bills, food expenses etc) and not co-operating in being transparent with his flamboyant expenses. He has a drinking habit and also beats my mother.
Recently he has sent voice recordings of his suicide threats to my mother's side family members in order to get paid at least Rs 15000/- per month.
Both me and my brother have been sending money home regularly but his demands for more money are simply not acceptable.

I am willing to approach the Chennai police but unsure how to proceed.

Please advise if there is any legal action I can take in order to curb his attempts of black-mailing family members.

You make complaint against you father and show them that voice recordings of suicide note, so as per IPC section 309 attempt to suicide can be filed against him.


And threatening, harassment, torturing plus your mother can file FIR against him under DV act.

- Since , he is creating trouble for your mother , then she can file a complaint under the provision of domestic violence Act against his harassment , and for teach him a lesson. 

- Further , she can also claim maintenance from his as well, even he is working or not . 

- Further , for his regular threat , you all can lodge a complaint against him before the police for the offence of black mailing.

You have choice of lodging complaint against him with police for threats of committing suicide. 

Next steps you may lodge him in old age house. 

We are law abiding citizens and parents are our pride in Society. 

Apart from above two steps which is allowed under the provisions of law, No third step is allowed under the law. 

Hooliganism, torture, threats, criminal acts,thrashing,blackmailing etc  are not the acts of law abiding citizens and I would never advice you to resort to such ways of setting your father right on track of life.


Follow up is the duty of concerned officers to take next steps if matter doesn't appear to be improved.

The suicidal threats is a strong evidence e to lodge a criminal complaint against him for blackmail activities.

Since your mother is residing with him together she is the best person to lodge all kinds of complaint with the police including the acts of cruelty, extortion, threats, threats for life etc.

You can take your mother to the nearest police station  and submit a neatly drafted complaint against your father venting out all grievances and his acts of cruelty seeking relief and remedy.

2. Now  its up to the persons to allow themselves to be blackmailed by the person or not.

3. Extortion is a crime for which the persons extorted can lodge complaint with local police.

Send your father at Old age home because the incidents narrated have not been cured legally. 

Actually, it's our duty to protect and maintain father and mother under the laws. So, where can we go? If you approach police without any complaint, they will not resolve the matter. If you complaint, it will harm you in back.

Try to record all his acts. If that is not possible then ask your mother to file a domestic violence case against him immediately on grounds you have aforementioned.

The children should also file a case of criminal intimidation and extortion.

You have to provide the information about the societal threat by your father to the police so in case there is any incident you can be saved so far as the maintenance of father is concerned it is the responsibility of the children to maintain for any other problem relating to the behaviour of your father your mother can take action in case she is being harassed by the father in police in case there is any e excess demand by your father then you may stop paying maintenance and let him go to the court and let the court decide the amount of maintenance so that you can provide that amount on regular basis.

Dear Ma'am/Sir,

1. You can give a written complaint of his behavior (including he beating your mother) to the Station House Officer (SHO) of the jurisdictional police station. His acts amount to offence under section 498A - Husband or relative of husband of a woman subjecting her to cruelty, and  offence of extortion as defined under section 383, Indian Penal Code

Specifically mention that he gives repeated threats to commit suicide and that this piece of information is crucial to be brought in your (police officer's) notice.

2. Keep all the evidences of his behavior safe with you. They will help you in case he actually commits suicide and police starts investigating it.
