Abhi yeha property ancestral property khelayegi, kyu ki aap ki 4th generation above 18 years hai.

Toh sabi  legal heirs ke saman hissa (equal share) hoga. he property abhi HUF act antargat ayegi.

To ek kar sakte hai aap aape ki gradn father ka share apne mother ke name Gift Deed kar sak te hai.

Pahile aap partition deed apply kar satke hai, Saab legal heir me equal sharing ratio.

Let us know the family history and Family Tree of all legal heirs so can tell you how it will go for sharing ratio.

You can do it with the help of grandfathers will if present. Otherwise with partition deed or gift deed between legal heirs

The property on the name of the father of your grandfather shall devolve equally on all his own legal heirs namely,  your grandfather and his siblings.

In the share of your grandfather's property neither his son nor his daughters have any rights  at least not during his lifetime.

In what way is your mother entitled for any share in it when your father himself is not having any share in it as a right.

Great grand Father ki property mein unki Beti  yani Aapke grand father ke bahen ki signature hona zaruri hai. Kyu ke Great grand father ke baad class1 legal heir Unka Beta aur Beti rahegi. bina signature ke property transfer nahin hogi

Sir aapka question clear nahi hai. Ek baar family chart ke sath question clarify karen ya kisi bhi lawyer se call par discuss karen.

For. Eg Grandfather se aapka matlab "dada" ya "nana" hai? Aapke grandfather ke kitne bhai behan hain? etc.

Dear Sir,

The best way to have the properties on mother's name is to get the gift deed in the name of mother.

jo zameen grandfather ne kharidi hai woh zameen woh kisi ko bhi de skte hain.

Magar unke father ki zameen mein unke alawa unke bachhon ka aur unke bachhon ka bhi haq hai.

Aap directly wo property apne yaa apni mother k naam nhi kr skte kyuki wo property ancestral property hai.

Aap log apna hissa claim krne k liye partition suit daal skte ho baaki sab claimants k khilaaf.

You can get the share of your grand father in the name of his children by way of Gift i.e., if  he gifts his share of property it has to be registered by paying stamp duty.

If a person has clear and marketable title to the property then he is considered to ber an absolute owner of the property.

By that meaning, the property owner can transfer his property to anyone of his choice and by any mode or manner to the donee.

Therefore your grandfather can very well transfer his entire property to his daughter, i.e., your mother by executing a registered gift deed, there is no legal infirmity in it.
