• Agriculture land plot (guntha land) owners association formation etc

Hello,
We are around 200 guntha plot owners of a agriculture land (having survey no), all plots purchased from a land developer individually in Maharashtra. Wanted to understand few things
1) Can we form a registored association OR we have to go for some kind of society formation or both are same? What is the process. Is this right approach to come toger and form a forum to protect land.What is the cost to form Association Or Society.
2) Assuming no land developer should be able to sale land without having government mojani/measurement done.if So shall we consider that doc as authentic doc to locate exact each plot locations wothin our project OR we have to get that done again? In that case, what is recommended, should we go for individual measurements for each plots or for the entire project. I heard cost is high if we go individual per plot measurements. 
3) If the land is under grampanchayat, can we build house with their permission. Will Grampanchayat provide us basic necessities like water road light etc. What is the process to initiate this process

No matter whether land is agricultural or non agricultural . if you all want to form a society than you can initially apply to registrar of MCS or your area and formed a proposed society and take all account and audit reports of maintenance from the developer and later on after election of society can do formation of body like chairman, secretary etc.


To build house in the gram panchayat you can have permission of Gram panchayat and collector .

A society is generally what people make for huge tracts of land. A society has to he registered under the societies registration act.

The cost is a few thousand rupees.

You may measure the property as a whole. Tge gram panchayat will provide you with basic amenities if you adhere to their regulations.

You can all join together and form a registered association in any name that may be suggested by majority members for the purpose of welfare of all plot owners. 

The cost and other issues may be enquired locally. 

2. If at all you want to develop the plots through a developer you may all enter into a joint development agreement which will cover all the aspects including the measurement of the individual plots. 

3. The grams panchayat is not a competent authority to approve construction in most of the states. 

The power for granting approval vests on the town and country planning authority.

1. An association may be formed and registered.

2. The document should not be considered as authentic on face value. Conduct all due diligence to ensure that documents are not forged in any manner. Individual measurements are not required if survey numbers exist and boundaries of plots have been demarcated.

3. Local lawyer only can answer on the permissions required to build house in a land under grampanchayat.

Any 7 members can form the society. Better form association, less complicated in comparison to society.

Maximum 10k fees.

Make boundary walls on plots and address of owners.

First check whether land is converted for residential purpose. Without conversion, construction not permitted.

If land duly converted than no permission require to construct house. Water and electricity supply is municipality job and not of gram panchayat.

A minimum of 7 members are requied to register a Society. A society shall be registered with the Registrar office under Societies Formation act 1860.

Panchayats have the power to approve layouts and residential properties within the boundary of their village. The rural development and panchayats have been granted permission by the government to approve layouts/residential properties that are within one acre of land within the village boundaries.

Dear Sir,

Since there are 200 owners and therefore the formation of the society will be better. The measurement by govt authorised person/agency will be better and the permission for house will be from concerned local government body. The utility services of water and electricity can be applied and get from concerned govt authority and not from gram panchayat.

1) Yes you can form society, you can approach Registrar of Societies for registering your society and all the Plot owners can become members.

You can hire services of local Advocate from your area.  Yes it is correct approach to form Society.  Cost varies. 

2) You have to get the measurement done for individual plots and you may also take comprehensive measurement of entire land (for record purpose).  Cost is not high, but it is cost effective i.e., each one of you will get correct identity of their respective plot with boundaries.

3) You need to get permission from Gram Pahchayat, providing amenities you need to contact the concerned departments.

1. Both association and society formation are same thing there is only difference of act under which it is registered. You should contact some local agent who can help you in registering the association and cost will depend on his services.

2. You should go for demarcation of complete land to mark plot no.
