1) schools can admit students without TCuntil Grade 8, For admissions from Grade 9 and above TC is compulsory. As per the RTE act, TCis not necessary for admitting the children in lower classes. Also, schools can't deny giving TC if there is no legal issue with the child.

2) section 5 of right to education act wherein Head teacher or teacher in charge is required to give immediate TC certificate . failure to give TC certificate invites disciplinary action against said head teacher

- It is well settled law , that any service provider like the training institutes, educational institutes/schools or the coaching centers cannot be allowed to forfeit the fees or consideration received in advance in case the student has not availed the service. 

- Even, if you have signed agreement , the school is bound to refund the  deposited amount.

- Further as per Section 5 of right to education act . School cannot refuse to issue TC to the student , who wanted to change the school. Hence

1. School , balance amount advance me mang nahi sakta hai , ye illegal hai , Balke jo amount jama apne kiya hai wo bhi bapas school ko karna hoga , chunke abhi class start nahi hua hai , yani school ne services nahi diya hai.

2. 8 tak class ke liye TC aur Report card jaruri nahi hai . 

- School TC aur Report card dene se mana nahi ker sakta hai legally.

- Give one application to the school , to refund the deposited amount . On refusal , you should send legal notice to the management of the school , and thereby ask them to refund the deposited amount , and to issue TC & Report Card.

- If, no response, then file a case in Consumer court for the getting the same. Sure you will get your amount refund and other documents as well.

Law is clear. Student to entitle to 100% refund in case of withdrawal of admission. And in no case, schools can withhold TC and report card. Such act is black mail and extortion.

1. The rules framed by the school are not enforceable in law.

They cannot demand fee for  the whole academic year especially even before  the start of the academic year and cannot withhold the TC or progress report for this reason.

You can take legal action against them buy giving a complaint with the district education officer or even drag them to court of law seeking relief.

2. It depends on the school where you would like to get your child admitted that if they would insist on TC or would manage to get your child admitted without TC on the basis of other records.

Generally the other schools insist on product ion TC for admitting the child afresh.

Apne admission liya hai aur fees bhi bhar di hai. jabtak apki bachi us school me padh rahi hai, tabhi tak aap fees bharenge. Jab transfer karana hoga to application dekar transfer bhi karayenge. सर्टिफिकेट तो जरूर लगेगा अगर स्कूल बदलना है तो ।
आप CBSE को कंप्लेंट करे जो वो पूरे साल की फीस मांग रहे है उसके लिए ।
आप कोर्ट में स्पेसिफिक परफॉर्मेंस सूट भी डाल सकते है स्कूल क खिलाफ ।

the rule is there because the school took your ward for admission to higher class while many applicants would have not been entertained

so if the ward's parent thereafter decides to cancel the admission then the school would have lost a potential ward who was also waiting for admission

also you have signed on the school admission form and thereby agreed to the terms of admission

if you do not pay the balance instalments and if the school deposits your cheque and if that is not honored then the school can initiate cheque bounce case against you

if you want your ward to be admitted in another school in another state then transfer certificate or leaving certificate will be required by the admitting school

you can request the school to take in any waiting list candidate instead of your ward and thus give TC/LC to your ward
