• Original Grant letter missing

Hi Sir,

I have booked a flat in an apartment. During the legal verification, I came to know that the original/copy of the first grant letter issued by the government is not available either with the builder or in Taluk office. It is claimed that the grant letter was issued in 1941. After that there have been quite a few sales. Consequent sales and registrations are recorded at the registration office. Pahanies also show owners as per the documents provided. 
The land has been DC converted in 2006 and since then the builder owns the land.
There are property tax paid receipts too at different time periods.

The only document missing is the first grant order. 
Could you please let me know, is it safe to assume that there will not be any litigation from Karnataka government in respect to this land as we have the Pahanies, registration documents, tax paid receipts and DC conversion order?

What is the grant letter concerned with this property, was this property granted or assigned to this owner by the government?

Did you obtain a legal opinion to confirm the genuineness of the property on the basis of the papers produced before you?

If not then you may first obtain a legal opinion and clarify the importance of the missing grant letter because the advocate giving his opinion after scrutinising all the documents would be the better person to render a proper opinion and recommendation to buy this property.

You need the original grant order  issued in 1941 

 

2) it forms basis of title of builder to property 

 

3) we cannot say that you would not face any problems from govt as no such grant order is available in govt records

Dear Sir,

The documents available with you are enough proof of ownership and you can contest any litigation citing that issuance and preservation of documents at govt offices are not under your control.

Sir the first document in property chain document is missing which forms the basis of the title of the property though after that number of documents have been done and DC permission is also granted so there are less chances after so any years for litigation but it cannot be assured there wont be any litigation.

Apply for a copy of the Grant letter, if it is not available at the Government office, they will issue an endorsement confirming that the letter is not available. Based on this letter, you can proceed to purchase the apartment.

Since other government related documents are available it is safe to proceed with the above endorsement.
