Dear Sir/Madam, I am a Student of Sikkim Manipal University Distance Education. There is a court order of 2014 pertaining to Territorial Jurisdiction which says that universities giving distance education cannot conduct exams out of their territory. Now I joined SMU in 2018 for MBA through distance education. I have written the 1st semester and 2nd semester exams in my city. SMU never informed us about the 2014 court order to us. Now they are asking us to come to Sikkim to write the 3rd semester and 4 th semester exams as they lost their petition challenging the 2014 court order. 1. It is very difficult for us to travel 2500kms to write the exams. 2. Even if we write the exams , we dont know if the degrees will be valid by UGC( SMU had said while taking the admission that their course is UGC valid) What can we do?

20 better go to sikkim to write your exams other wise your one year would go waste
1. You cannot claim any exemption towards this especially when the orders have been passed by supreme court, you have to comply with the requirement of law in this regard or to forego the same.
2.You should have confirmed all these things before sending an application for pursuing the studies through the said university, you cannot blame someone for your ignorance of law.
Law is common for all hence you decide whether to continue the education from this university or not
Thank You Gentlemen for your precious advice. I have the following questions. 1. Isnt the university liable to inform us while taking admission that there is a court order regarding territorial jurisdiction. 2. The problem is not for me individually. There are thousands of students facing the same problem. So can we file a petition in the supreme court saying the university has not informed us and should be liable to refund our whole fees/compensate our travel for writing the exams?
University should ha e informed you about court orders
2) file complaint against university before consumer forum for deficiency in service and seek compensation for mental torture undergone by you
You need to first raise the issue with university then challenge it in high court under writ petition
Better file consumer complaint agasint SMU. First 2 semesters are still invalid and due to this either full decree will declare invalid or re scheduling of 1st 2 semesters.
SMU intently concealed the fact, hence committed fraud.
Refund our whole fees/compensate our travel for writing the exams - by filling consumer complaint or direction from SC.
BUT copy of HC order was published on SMU website by direction court. Haven`t you read that ?
1. You should remember that the university did not approach you, but it was you who have approached university for this purpose, hence it is you who should have enquired about it properly before getting admitted to the university.
2. Even all the students combining together to file any writ petition either before high court or supreme court, you all should know the fact that ignorance of law cannot be claimed as an excuse, hence it is you who should have enquired about it before choosing a distance education program from a very distant university.
In my opinion, your case may not maintainable.
1. You should file a case against SMU in consumer forum for claiming the compensation for not disclosing this fact before giving admission.
2. Now you can only claim the losses suffered by you due to this scam against you. You should also claim compensation for loss of one year of your life due to this scam.
