• Complain against ECOSOC policy

We have been issued 1 hectare of forest land by ECOSOC in 2009 for the lease amount of INR175,000/- for 5 years and in 2014 it was raised to INR425,000/- for next 5 years which has not been justified until now. And after 2019 the ECOSOC Haven’t sent us any extension letter and nor have asked for any fee until an year..

Have you been paying the amount enhanced and demanded periodically ?

You may either wait for a response from their side or you may personally visit the office of the department and clarify the details.

You can wrote to them for extension of lease period as term of lease was only for period of 5 years and it has expired

1. Have you paid the enhanced lease amount sought by it? Has a legal notice been served by you on ECOSOC to controvert the enhanced amount?

2. The original lease deed has to be perused to formulate an opinion on the rights and remedies. If there is a right there has to be a remedy.

Must have lease docuemtn executed with ECOSOC, provision of extension must be in lease deed. Check that or otherwise you send your intimation for further extension and lease amount for next 5 years.

Since it is forest land, and in absence of lease deed, lease terminable by giving 6 months notice period.

Dear Sir, 

Now You are in permissive and settled possession of lands as such you cannot be thrown out by anybody without recourse to law. you may approach civil Court and get an injunction against them stating that they should not evict you without filing a suit for possession.

If you are  continues paying lease amount after  lease expired and the authority accepts, then lease is automatically renewed.
