• Terminated by MNC (Software Company)

I was terminated by company due to below points:
1) There were some unethical things that was going in hiring process and management(by my manager) asked me to participate in it.
2) When i told no. He tried to bribe me monetary benefits like referral benefits for which i was not eligible. For that i have a proof too.
3) When i finally told that i will not participate and i will not allow this to happen then my manager started playing game with me like started assigning me more works and daily changing the work and started abusing me. Due to late hour work works and mental stress,I got Back pain and BP issues.
4) I had requested for sick leave and Sabbatical leaves which got denied by manager. For which i was eligible for as per company policy.
5) I complaint the same to higher management for my manager with proofs. For that inquiry panel was setup but they gave result in manager favor as i was not present due to health issues. May be many was involved in this corruption.
6) One day suddenly i got a notice that you are terminated.
7) When i called them they told don't worry we will pay you good compensation and they told we will give you relieving whenever you want.
8) When i went to Office they told me to resign. I did that.
9) I post the same in linkedin about this corruption.
10) Now i got job and i am asking them to give relieving letter. Neither they are denying nor telling when they will give.

Please suggest me what to do next

What is the need to mess with management. Unethitical practises are common in higher management.

Subordinate employees only suffers. Well, send legal notice to clear relieving , failure to which you will initiate legal proceeding before labour commissioner to claim relieving plus compensation.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like Intimidation, Fraud, Breach of Trust etc.... against the person/s, supported with all relevant supporting Documents & Witnesses.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person/s may come down for settlement.

What was the date of your resignation?

If it's been less than a week, you should wait a little more. After that, you can send a legal notice to the company asking them do to give your relieving and experience letter, otherwise you will to approach court.

1. If your resignation has been accepted then you cannot withdraw it now.

2. Serve a lawyer's notice for full and final settlement, and if it is not done then you may sue the employer in the competent court for recovery of money.

If you have quit the job then do it by tendering a resignation letter observing the employment offer letter conditions.

If they do not relieve you as per your requirement as mentioned in the resignation letter then you can initiate legal steps for relief and remedy.

You can first send  legal notice demanding the reliving letter, if they fail to respond or comply then you can drag them to court of law for justice.

you can send a legal notice to your employer if they have illegally terminated you from your job. However, it is pertinent to mention that you must have a termination letter or any written document which specify or can prove that your employer has terminated you from employment.

You can send legal notice but before that you should ascertain the facts that why do you want to send the legal notice and what relief do you expect through this legal notice  otherwise the legal notice may not be effective neither it will fetch you the desired result.

It is of no use of sending the legal notice to make the termination invalid as you have got a new job and if you go back to your old job, the same all things are bound to happen again.
