1. Constructing Brick &  Mortar Wall requires BMC permission.  All other types of partition walls using Glass Bricks, Plastic bricks, Wood Bricks, Planks etc.... do not require BMC permission, since these are classified as "tenable repairs", PROVIDED no changes or alterations are made in the Pillars, Beams & Columns for the purposes.

Only walls made internally in your house does not require permission of the Municipality.

The same is with ordinary walls abutting your boundary as well.

A flat owner will no longer have to approach the BMC for permission to change the layout of his house, like reducing the size of a bedroom or expanding the hall.

As long as the load bearing walls or pillars are not touched, the civic body will not interfere during the renovation of a flat.

As per section 342 of BMC Act, 1988 (amended till date), the following “tenantable repairs”, can be carried out without obtaining permission from the 'Building and Factory' department of local BMC: Plastering, painting, pointing of your flat. Providing guniting to the structural members or walls.

The “tenantable repairs” however shall NOT include the following:

  • Replacing or removal of any structure members of load bearing walls
  • Change in horizontal or vertical existing dimensions of the structure
  • Lowering of plinth, foundations or floors
  • Addition or extension of mezzanine floor or loft
  • Flattening of roof or repairing roof with different material
  • No merger of tenancies by removal or opening of any walls in between two or more tenancies.
  • Changing location of bathroom/ WC/ kitchen sink, in a way that can cause leakage to residents below.
  • Increasing the internal height of the structure

Partition walls if objected by court injunction cannot be constructed. Other wise if the said walls are illegal then only it can be demolished. In a legal property bmc can't interfere for construction of boundary walls

Any particular construction that was not part of the original plan has to be notified to the bmc.

Therefore a partition wall should be notified.
