You have to write divorced. No can create trouble.
I am a divorced man got divorced in June 2018 as per the advice of woman's cell. Everything has been settled. There was not any FIR filed against me. I got a letter from woman's cell regarding complained from my wife. I visited there both were agreed for mutual divorce we filed for divorce in Nov 2017 and got divorce in June 2018. The officer in woman's cell said if I didnt came when I was called by them they would have lodged 498a case against me but I went to them and agreed for mutual divorce as we both didnt want to be together. After divorce I asked officer woman's cell officer is there any case against me or not ? She said no if there was any case you would have been arrested and chargesheeted. I was never arrested and chargesheeted. Officer said you are free now and no charges against me. All the divorce proceeding were done in satara while I live in Mumbai. I was called in woman's cell satara. My local police station was never involved in this at all. Now my question is I am selected for govt job which requires attestation form to be filled for police verification. There is a question like are you married ? I wrote "no" will it cause any problem because I am a divorced man
First answer received in 30 minutes.
Lawyers are available now to answer your questions.
Yes if option of divorced is not there then in your martial status you will.mention no only as there is court decree evidencing your divorce.
You dont have to write anything unless specifically asked. You can write single or divorced if you are legally divorced through decree of court
1. No you should mentioned your status as divorced.
2. Mentioning not married or single would be considered as concealment of facts in future if some problem arises.
You should not suppress the facts while filling up the application for the employment, there is nothing wrong in filling up the correct details in the application form.
You can mention about your marital status as divorcee.
1. You are not married anymore. If the question is 'Are you married?" You can answer in negative.
2. If, however, there are multiple options to choose from and one of the options is divorcee then you must select divorcee.
Thanks for your suggestions but my actual problem while filling the attestation form is , there is a question ," are you married ? Yes / No. Sub question if married then give the details of spouse. There is no option for mentioning divorced or widow. Even while filling police clearance certificate online there is question are you married ? If I click on yes then system asks details of spouse. If I select "no" then system doesn't asks any question and I can go ahead with the application. Its been 1.5 yrs since we separated and don't want her name in any of my affairs. We are judicially separated I have the decree. The question they are asking is are you married or not ? If there is any other than that I would have chosen the divorced option.
if you are divorced and you have divorce decree passed by family court then you can answer that you are not married
Judicial separation and divorce are different. If only JS than YES will click.
If divorced and no third option than fill NO.
The question is about the marital status.
You cannot say that you are not married.
You have to mention that you are married and may have to furnish the details of the spouse.
Whether you like it or not you may have to obey the law and abide by the rules.
1. Have you got the decree of divorce from the Court after jointly filing a Mutual Consent Divorce petition before the said Court?
2. If yes, then certainly you have collected the copy of the decree of your said divorce.
3. In your case you should write 'Divorced' as a correct answer.
4. However, you can also mention as 'No' as specific answer to the said specific question.
1. In the given circumstances you should mention 'No'.
2. 'No' shall be the specific answer to the specific question which has left no alternative to mention other than 'Yes' or 'No'.
