• Buying a building on commercial road for which an industrial plot has been alotted

1.There is a property we wish to buy on commercial road in residential area.
2.We want to use the building for Commercial activities.
3.There is an Industrial Plot already allotted to that property in Industrial Area.

I want to know if we purchase that Building(With the above three conditions) do we have any liability when we use it for commercial activity.
We will be giving Conversion charge and Parking Charge,


The property is in Delhi, Plot allotted in Bawana Industrial Area.

You are willing to pay the conversion charges for usage of property fir commercial purposes 

 

2) you will have to pay higher property taxes , water charges and electricity charges if premises are used for commercial purposes

If it's a commercial property you will have to bear all the expenses as commercial only. Yes you can do conversion or change of use

1. This can be done PROVIDED you move application before the local Municipal corporation for "change in usage" for your purposes, alongwith Architect's report & drawings and by undertaking to pay all statutory dues /charges  at applicable commercial rates.

2. You would also need NOC from adjacent neighbors plot-owners  for your commercial activities (depending on type of business.

Plot may have allotted as compensation against allotment @ Resettlement. Commercial and industrial purpose are different, have to convert land use. Once conversion letter issued, can be used in any unrestricted commercial activity.

Tell seller to provide govt. NOC and conversion order.

1. Agar us plot ki commercial activities ko band krne k liye already industrial area me plot alot ho gya to haan govt can object for doing commercial activity in that building.

2. And they can also put fine and seal the building for commercial activities

If you are using the Industrial area for commercial activity you may have to apply for conversion of the same from Industrial to commercial area.

Since it is located on a commercial street, it will be easier for you to convert the same into commercial area citing the existence of the facility in the vicinity.

Yes there can be problem in the given situation. Taking plot for that property makes it illegal for commercial use. You may use it even then however the problem can come anytime.
