Can we combine defamation 499 and 500 with below case or we need to file seperately 

Case u/s 211 of I.P.C.: 211. False charge of offence made with intent to injure
468. Forgery for purpose of cheating, 469. Forgery for purpose of harming reputation,

A separate complaint for same has to be filed before the police, police may register FIR on same and arrest the accused for same.

See you can combine them under same complaint before the magistrate court.  Though since cheating case is cognizable.case if.you file police complaint in.that case person may be arrested on FIR.

- If , trial of the case under section 211/468/469 already started , and there is an FIR for the same, then you cannot combine the defamation sections.

- If, you are going to file a petition under the section 200 CrPc for lodging an FIR under sections section 211/468/469 , then you should file a complaint before the magisterate for the combined offence of section 211/468/469/499/500 of IPC , with an application under section 156(3) CrPc.

For filing the criminal cases on the proposed sections, you should have substantial evidences to prove prima facie the existence of any such case.

You may first approach police and lodge a criminal complaint under the said provisions of law, if they fail to entertain then you may approach the court with a private criminal complaint under section 200 cr.p.c. 

The same procedure is applicable for filing defamation case also i.e., you may have to file a private criminal complaint under section 200 cr.p.c. for filing the defamation case.

Dear Sir,

No person including spouse cannot damage reputation of another spouse as such it is your civil right to file a civil suit restraining her from approaching any of the above medias and from publishing anything about you.  Further you may file defamation case on the available date.

Defamation can be viewed criminal as well as civil offence. under Sec- 499 & 500 of Indian Panel Code victim can be filed a criminal case for defamation against the accused

1) Defamation cases are of two types, criminal and civil.

2) In Civil defamation, a mala fide intention to defame is not always necessary. If defamation is caused, thenbsuit lies. Court fees are required to be paid as per value of damages caused to reputation.

3) Criminal defamation must, in addition, contain some deliberate malice or malafide intention, to cause damage to reputation of someone.

Here, court fees are NOT required at The level of a civil case.

At the end of case, court punishes offender  if defamation is proved.

3) In civil defamation case, at end of case, court awards damages to compensate loss to reputation if defamation is proved.
