• Amazon asking for customer PAN and Aadhar after not delivering a product

Hello,

We ordered two bottles of a powder on Amazon and when we opened the box few days later we found only one bottle in it. Now Amazon says we have to upload our PAN and Aadhar for them to do an internal investigation and they will not entertain any talk about return or refund.

Why should we as customers upload KYC for their problem? Is it even legal? I want to send them a legal notice for this.

I understand that your item is missing from the shipment. In order to proceed with our investigation regarding this, we need you to upload a copy of your photo ID proof (Driving license, Passport or PAN card or Aadhaar card).

Your ID proof will be stored on a secure, dedicated database and will be used solely in accordance with applicable law and Amazon’s privacy policy. In addition, our secure server software encrypts all of your personal information so that it cannot be read as the information is sent to us over the internet.

In order to upload a scanned copy of your ID proof to your account, please go to the following link on your desktop or mobile browser and follow the instructions:
https://www.amazon.in/gp/kyc?ref_=_kyc

Note: Please do not share your ID proof details over email since it is not a secure way to share personal information. It will take us up to 5 Days to complete the investigation and our investigation team may contact you for inquiries. We request you to contact us on February 10, 2020 for an update on this matter.
Thank you for your patience and co-operation.

NO Pan and adhaar required. Only for those who are registered with it and can upload their driving license number for KYC.

But KYC dose not require for complain purpose of whcih order already made. Advance KYC could have asked but not later. And not on online placing order, KYC required.

Initiate consumer complaint.

1) no need to send legal notice

2) just upload scanned copy of your id proof ie driving  licence or pan card

3) sending legal notice is an expensive proposition . costs would be more than value of goods ordered by you from amazon

- Amazon is an online shopping website , and not a banking or financial organization , hence there may not be any requirement of KYC for the same as per law.

- Since, your shipment is missed by the amazon , then you should lodge a complaint online as well.

- Amazon is bound to refund the amount paid by you , otherwise , if you will complaint against them for deficiency of services , then amazon will have to pay more as well .

- Hence, just lodge a complaint online , if no response , then send a demand legal notice for the same.

You need not to provide any such document for the internal investigation purpose however in case Amazon denies to make the investigation and compensate the losses then you have the option to complaint with the consumer forum of your district  to claim the amount, compensation and legal charges .you need not to provide any such document and request of any person

Probably they want to verify your identity and to satisfy that you can part with details of other identity proof like voter's card or driving license or similar proof.

Demand of adhaar card or pan card is surely not compulsory to investigate your complaint.

You can lodge an online complaint in the customer care cell of the company. In alternative, issue them a legal notice. If still your grievances are not redressed, file a consumer case in consumer court

1. You can upload the IDs proofs as asked by Amazon this is just to confirm that you are the same person who ordered the items.

2. If they still doesn't entertain you claim then you can file complaint with consumer forum against Amazon.

3. You can file complaint by yourself or you can hire lawyer for filing and contesting you case before consumer forum.

If you  desire to issue legal notice you can draft the same on your own on the basis of the grievances you have on this and demand refund of your amount or product without furnishing the KYC details.

If you are not knowing the technical procedures, then you may contact any advocate for this  for an effective notice.

You can visit the jurisdictional consumer court within your place or district, and ask the procedures  for filing the case, because the online websites may not give clear details for filing the case online
