Can Red corner notice be issue on the IPC sections- 498A, 3,4 DPA. How long would it take and what are the procedure to get it issued.

The SC has held In respect of persons ordinarily residing out of India impounding of passports or issuance of Red Corner Notice should not be a routine.

 

2)personal appearance of all family members and particularly out-station members may not be required and the trial court ought to grant exemption from personal appearance or permit appearance by video conferencing without adversely affecting progress of trial.

 

 

 

3)red corner notice is issued

It cannot be issued in 498a case red corner is issued by Interpol not by state agencies in India.

CBI can only request Interpol to issue Red corner notice. 

If the person is traced out in any country ,  extradition process should be initiated in the court of that country .

There should be an arrest warrant issued by court or Charge should be filed by CBI. Only then CBI can make a request for RCN.

The court itself where the case has been registered can issue non bailable warrant against the husband. This warrant can be submitted to the passport office and they can impound the passport.

If a person whether an Indian or a foreigner has committed an offence in India and is subsequently believed to have absconded to a foreign country, a request can be made by the concerned police authorities etc. to the Interpol Wing of the CBI for publication of an 'A' series (red) notice against that person.

For that you have to send a written request to Suprintendent of Police for issuance of Red corner notice against the accused.

1. Red Corner Notice cannot be issued in a routine manner in matrimonial cases, but there is no absolute bar either to the issuance of RCN.

2. If it is shown that husband has fled the country and is continuously evading the courts in India then it can be issued.

3. You have to apply to the union govt to issue RCN.
