I just wanted to know that can I go and study abroad if I have case pending towards me on IPC 279/338 . I have a NOC from court which was stated to passport office that my passport can be issued and their is no restriction on me traveling abroad. So passport authorities have issued my passport for one year and I have even travelled abroad with that but I am just confused with this whether I can go and study abroad or not till the case is pending?

You can travel to abroad and return after short duration.
Going to abroad for studies will involve longer stay or permanent stay hence during pendency of criminal case the court may not permit you to travel abroad for studies.
The passport itself is valid for one year only, after that for renewal you may have to obtain court permission.
Hence you may not be able to travel abroad for study purpose.
You are at liberty to go abroad for further studies

- As per law, if the bail granted conditionally , that the accused cannot travel outside India , then the accussed is bound to surrender the passport before the court , and even arrested for his disobedience.
- Since, you have already granted permission from the said court , and the Passport authority issued the passport on the direction of the Court , hence no need to be confused , you are free to travel abroad for your study and for other purposes.
- When the court will require your presence , it will issue a summon to you for the appearance , and further you can move an application through a lawyer in India for your exemption , on the ground of studing abroad.

Yes. Not a very grevious offence. Can happen to anyone. Just in case u r so worried, inform the court and ask fr n.o.c. But please see that if u r contesting the case , u r available to the court of law for trial. U can also mention this in u r passport application. It is neither serios crime nor a case of moral turpitude hence they cannot deny u passport.
There are different criterion for different services. Some services want no criminal record or no punishment record. Some give some relaxation and specify that there should be no record of heinous cases like theft, loot, murder, rape etc. Accident and normal fight, family disputes are not serious crimes.
Though fine is considered as a punishment so definitely you have a criminal record in police books. But since it was an accident, it should not have adverse effects on your career.
Please get the copy and ho through court order. Sometimes the court mentions in the verdict that though the accused is guilty and fined with so and so amount but it will no affects his/her career.

You have court permission to visit abroad, only need to take care that you should present in court on hearing date or your advocate file exemption application on every date.
Yes you can go and study abroad if a study visa is granted to you though after a year you need to seek approval of court.
