Completed 7years marriage life.
I have a one 6years girl baby.
My wife's thinking and her attitude not satisfied me as. Following.
1) She is not trying to understanding my feelings and not responding to same. She is not listening my words.
2) She is always think and taking care her mother family only not to me and my mother family.

Well, only few of the husbands are there on face of the earth whose voice is listened by their wives. So you are among the commoners and not among the privileged class.

on a  serious note, this not a issue which seeks legal intervention.

Try to make reason with her to make her understand that it is important to take care of both the families. i am sure she would understand your words and you would get marital bliss in not time.Good luck.

  1. Convince your spouse to agree for Mutual Consent Divorce. Better to  opt Mutual consent divorce route and mutually the husband and wife can take decisions in the matter of child custody, finance, assets, maintenance or alimony, returning the jewellery given by  your parents and relatives etc.

2. In the joint petition to be filed by both husband and wife for dissolution of their marriage U/S. 13-B of the Hindu Marriage Act (Mutual consent divorce) , the custody of child, maintenance, finances, property matters, visitation rights will be mentioned.

3. The reason can be mentioned as due to irreconcilable differences they have been living separately since one year, and their marriage has broken down irretrievably and efforts to bring about reconciliation have also failed.

4. The time for concluding mutual consent divorce will be 6 months and this cooling period of 6 months can also be waived off in certain cases.

You have to file divorce case against your wife on the ground refusal of sexual relationship and her attitude it means mental and physical cruelty on you, it is best ground for to take divorce from your wife by filing divorce case before jurisdictional family court on the same ground.

1. See you can talk to your wife and resolve the issue if it is not solved then you can ask a mutual divorce from wife and can offer her some settlement amount if she is not agreeing same then you have to file a contested divorce on ground of cruelty.

It seems your wife is worried or troubled with some issue in her mother's family. Try to talk to her taking her in confidence. With your mental support she may disclose her problem. Both of u should take of your daughter. Don't think of getting a divorce at this juncture with no solid reason.

No need to go for divorce on initial stage.

You both need counselling session to decrease the difference of thinking between both of you. 

And to make your wife understand about your needs and priorities.

Divorce is step which is taken when the relationship is destroyed to the extent that it cannot be cured.

- Supreme court has granted Divorce to a man on the grounds of “cruelty” after his wife refused to share a home with her in-laws.

- Hence, legally your wife cannot refuse to live with your parents , specailly when they are old aged, and further you and your wife are also duty bound to take care to your parent as per law.

- Better to resoslve the matter with the help of respectable persons of your family. 

- Otherwise, if she is not interested to continue with you , then take her consent for mutual divorce.

the information you have given here as reason for divorce are trivial in nature and do not constitute strong grounds for seeking divorce.

These reasons are not  sufficient to file  divorce case, the court may not entertain your divorce petition, however that will not restrict you to file a divorce case on the grounds of cruelty.
