  • Discrepancy in my personal details across all the certificates

Hi, All my certificates have different details. Spelling mistake in my name and my father's name. Please see the attached image, I have listed my details in all the certificates/documents. Could you please suggest, what can I do to correct my details. My date of birth and name is correct in my birth certificate, passport and marriage certificate. But it is different in all the education certificates. Also, will there be an issue as my first name is not complete? Some places it is written as 'Mohd', some places it is 'Mohammed' and on some documents, it is just 'M'.

You can file an affidavit stating your correct name. You can also go for Gazette notification and news paper publication too

At any time an objection is raised by any Govt Authority with respect to the discrepancy in your name in your various documents, furnish before them an ‘one and the same person affidavit’.

Bringing uniformity in all the docs is quite an uphill task and will consume a lot of time.

No this is not a big issue you can make a name declaration affidavit and get it attested from notary.

For change in educational certificate there is limitation if 10 years so you can make application to board for change of name with in 10 year from date of issue of certificate.

You should mention the proper name in the same which you want to continue. Don't use short forms in authentic document. Later you can use short forms wherever you want

but if name  is wrongly mentioned in educational certificates then apply to university to rectify the mistake

Your name as reflected in you PP, BC & MC is correct.

The word "Mohd. & Mohammed" and synonymous and does not need any correction, but if "M" is used it needs to be explained.

Name in your Educational Certificates, it is better to approach the University by making an application for correction of the same.

Dear Concern,

Please note - 

01. There are two ways to solve this crisis.

(a) One is to mention by way of Affidavit that you write your name as 'M' and 'Mohd' and 'Mohammed' and all shall be treated as same only. To do this - 

(i) You have to prepare an affidavit and have to get it notarised,

(ii) Then you have to get it published in the local newspaper both in Hindi and English and in local language like Telegu,

(iii) Then you have to get that published in National Gazette by submitting documents as per their requirements and your issue would stand resolved. 

Once you are done with this part then you have to get your father's and mother's name corrected by adopting the same process that is affidavit, notary, newspaper publication and then National Gazette. 

(b) Second option is to adopt one name throughout and to get it written everywhere be it 'M' or 'Mohd' or 'Mohammed'. To this also you have to go through same process - affidavit, notary, newspaper publication, national gazette. 

Then you will adopt similar process to get this done for your mother and father name as well. 

Whichever ways you adopt (a) or (b) once you are done with it then you will approach the concern authorities one by one to make corrections in their record and to issue you and your parents new and corrected certificate, identity proof etc.

1. You have to apply to the concerned board/university for rectification of name in the academic certificates.

2. If period of 2 years has lapsed from the date of issuance of certificate by the concerned board then it will not allow any rectification.

3. You will inevitable require court orders to rectify the errors. In this regard you may file a writ petition in the jurisdictional High Court,

You have to make a gazette publication with the proposed name and existing name in the prescribed format. For publication in Gazette, one has to comply with certain conditions like, publication in news paper, affidavit, submission of identity card etc. After the same is done, we have to approach respective department/university to change the name in each certificates like SSLC/CBSE, Degree certificates,  etc. For making change in all the documents, it will take 2 to 3 months approximately.

First of all ascertain your correct name which you desire to take it in future in all correspondences .

After that just assort all the documents where you have found your name or spellings that have been wrongly mentioned. 

After that you prepare an affidavit mentioning the errors occurred in all those certificates  and affirm the correct name with correct spelling and then get it notarised.

After that get the affidavit published in a local newspaper which will be sufficient for all practical purposes.

Dear Sir,

You say that you have an order of the JMIC  about your correct date of birth. In these circumstances you will have to go to all the concerned offices where the entry is wrong and show the said order as ask them to correct the same , and they should correct the same.

I am not aware as to what is ordered by the Judicial Magistrate. I am of the opinion that you may have and if you hadn't you should have filed a suit against the education board and the other concerned authorities praying to the court to pass and order directing the said Authorities to correct their relevant record and issue corrected certificates and documents to you.

In that case the onus of corrections would have shifted to the said authorities and could have been sued for contempt of court , in case they failed to obey the said orders. The said authorities would not have contested the suit as they had no personal interest in the same.

Maybe that you may have followed this procedure.

Any my advise should not be considered as a legal one and you may independently chose your course of action as suitable to you in the prevailing circumstances of your case.
