I passed matriculation in 1982.date of birth entered in original certificate is [deleted].but my father says i was born in 1968.the school made mistakes in school records and hence the error occured.Iwas appointed as a government school teacher in 1994.date of birth in my service book was entered as per my matriculation certificate as [deleted].In 1996 I wrote an application to block education officer with an affidavit to correct my date of birth as [deleted] as he had opened my service book.but no response was taken.In 2004,I wrote another application to district education officer to rectify it but again no response was taken.I have no proof as to my correct date of birth.Both times I applied on the basis of affidavit by my father.After that I lost hope.Is there any way out to rectify my date of birth in service record?

- As per Fundamental Rules , every Government servant will retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.
- Further, the date on which a Government servant attains the age of 58 years or sixty years, as the case may be, shall be determined with reference to the date of birth declared by the Government servant at the time of appointment and accepted by the Appropriate Authority on production of documentary evidence such as High School or Higher Secondary or Secondary School Certificate or extracts from Birth Register.
- An alteration of date of birth of a Government servant can be made, with the sanction of a Ministry under which the Government servant is serving,
- Further , this alteration should be made within a maximum period of 5 years only.
- Since, the date of birth in the service book was entered as per your matriculation certificate , which is an acceptable documentry proof as per law, hence on the basis of an Affidavit , it cannot be changed.
See if there is no proof as birth certificate and hospital record then there are least chances of change of DOB.
Court may also reject the application therefore in view as such there is no use for change of DOB now.
If you have hospital certificate or gram Panchayat or municipal corporation certificate on that basis you can apply in state government gazette for correct date of birth.
You can rectify the same only if you have any concrete evidence of your correct date of birth with you
You cannot change the DOB merely on basis of an affidavit by your father it should be supported by atleast one documentary proof do that you can prove your DOB is original.
Change in DOB can only be done if their is a discrepancy between the school records and the board records.
The same can not be rectified now at this stage

What about the birth certificate?
If the birth certificate is having the correct date of birth then you cannot change the same merely on the basis of your father's affidavit.
What is the veracity of your father's affidavit?
Whatever it is, how do you say that it is your actual date of birth, do you have any proof to prove your actual date of birth, viz., birth certificate or hospital records etc?
In my opinion you may be wasting your time and energy on this, instead set them aside and carry on with your routine work ignoring this because it will not be possible to get your date of birth changed without any substantial proof to prove your correct date of birth.
