Dear Sir/Madam, I live in Bangalore. We had purchased a 30x40 sq.ft plot in Unnathi Sunshine gardenia in the November 2015. At the time of purchase, we had paid maintenance fees(0.44/sqft per month) for a duration of 3 upcoming years(till 2018 October). After the lapse of 3 years, the builder(Unnathi) has hiked up the price to 1.5/sqft per month and is harassing the plot owners to pay the amount at the earliest. It comes to 18/- per sqft per year and is unreasonable for an empty plot. He is only providing security and no other amenities. Moreover, none of us actually live there as it is almost 50 KM from city center. Kindly advise on how to deal with this situation. Thanks, Krishna

From the time one books a house to actually getting its possession, there can be plethora of charges, some disclosed upfront, while others are buried under the loads of agreement papers, which are typically signed blindly by the buyers.
One such charge is the maintenance agreement between the buyer and developer. Most buyers do not pay much heed to maintenance charges in the initial stage of booking, but it comes back to haunt them as the possession date nears.
What are maintenance charges?
Every housing society has some common areas and as per the Real Estate (Regulation and Development) Act or RERA (well, even before the Act came into existence), the promoter or the builder is responsible for providing and maintaining essential services on reasonable maintenance charges to be paid by the residents.
Once the society's Resident Welfare Association (RWA) is formed, and the maintenance work is handed over to it, the builder can no longer charge for maintenance. RWA can then devise its own set of rules for maintenance charges.
Maintenance charges are applicable for parks, gardens, lobbies, stairs, elevators, fire escapes, entrances and exits of the building, community centres, common parking areas, installations of central services such as power light, air conditioning, and things that are necessary for a society's existence, maintenance and safety.
Please check your agreement, if in the agreement your builder has asked you to pay such charges and maintenance charges, then you are required to pay.
If there is no amenity being provided by the builder, other than security services, that too for an open parcel(plot) of land; this amount seems unjustified. If the builder pesters you to pay, tell him that at best you can pay him @ 0.44/sqft per month.

You may get issue a legal notice and clearly mention that you are going to social channel and concerned authorities for blackmailing you and enriching himself at your cost. They will be afraid of reputation.

Any action on the part of the builder will be as per the agreement done between you and him. You may a file a suit for specific performance and injunction against builder for doing only right and restrain from doing illegal things.
1. If there is a clause in the sale deed which permits the builder to enhance the maintenance amount after lapse of 3 years then he is free to enhance it.
2. If you are unwilling to pay the enhanced maintenance amount then you may refuse to pay it. The title of plot will still remain with you and will not be extinguished due to non-payment of maintenance amount.
3. Send a notice to the builder to inform him that you are unwilling to pay the enhanced amount as it is unreasonable and arbitrary.
Builder cannot charge maintenance charges for empty plots because he is not providing any necessary amenities and just proving security for plots.
You can deny to pay maintenance to builder and ask for bills for which he is charging such High rate of maintenance.
Paying maintenance to the vacant site i.e. plot is ridiculous.
You may be required to pay a fixed amount towards security but if there is no maintenance required to vacant site then you may not pay any such thing.
You may peruse the conditions mentioned in the sale deed and initiate proper legal steps to curtail this menace.
