• How to correct Mother's name on child's birth certificate in Maharashtra?

My daughter was born in Feb 2018 in Aurangabad Maharashtra.
Her mother's name (My wife) on birth certificate is typed incorrectly.
My wife's all documents have her name as one before marriage. 
My daughter's birth certificate has my wife's name as her name after marriage(the name which is on none of my wife's documents.)
We ignored this as we thought we will change her name later and we need not change the birth certificate then.
Now we have applied for passports for both of them.My wife has applied and received passport with her before marriage name.
We mentioned same name in my daughter's passport application but my daughter's birth certificate has her name as after marriage(Again which is on none of the documents)
So my daughter's passport application is stuck and objection has been raised by Regional Passport Office.
How to get the name corrected on birth certificate?
We wish to update birth certificate of my daughter to reflect my wife's name consistent with her documents.
Also how long will this process normally take?

Apply to registrar office to rectify mistake of your wife name in your daughter birth certificate 

 

2) enclose affidavit mentioning correct name of your wife 

 

3) enclose documentary evidence of her correct name

Approach the Authority which had issued this birth certificate, and prefer an application for correction in mothers name. This application must be supported by the relevant documents reflecting the correct mothers name.

If the needful is not done and they sit tight over your application seeking correction, approach the High Court and seek necessary directions

You won't be make any changes in the birth certificate as of now, however you can change your daughter name as per passport requirements by giving advertisements  in two newspaper, affidavit and state Gazette. These are the 3 requirements will need to fulfill from your side and it will take maximum 15 days.

1. an application in the prescribed format will have to be made to the competent authority u/s 15 of the Registration of Births and Deaths Act, 1969

2. all the documents showing the mother's before marriage name and any document evidencing her after marriage name will have to be annexed to above application

3. also an affidavit stating that the before and after marriage name is of the same person, will have to be made on a Rs. 100/- stamp paper and the affidavit has to be notorised

4. if required public notice in local newspapers may also have to be issued

5. it is not possible to comment how long the process would take since the officers here are in majority cases lackadaisical

6. the section 15 application as above can be followed up though by filing a Right to Information Application for a quicker response

7. you will have to inquire with the local Municipal office for the details of the officer to whom the above application can be submitted

Is there a mistake in the way your parents name is spelt in your birth certificate? You can write a letter to the Registrar of Births and Deaths under your Municipal Corporation requesting change/correction of spelling of name of your mother or father. Here is a letter format for your reference.

What problems can my mother's/father's name incorrectly mentioned in the birth certificate create?

Your birth certificate is a legal document that clearly states your parentage. It clearly mentions the names of people you were born to. A birth certificate is issued by a competent government body. The responsibility of issuing birth certificates generally lies with the Municipal Corporation of the Ward that a person is born in.

Every birth certificate has the name of the person whose birth is being recorded, their exact date of birth, their father's name and mother's name and place of birth. Apart, from this a registration number is also assigned to the individual. All details pertaining to a birth are documented in the official records of the Municipal Corporation. If a child is born in a hospital/clinic the authorities there do the relevant paper work for registering the birth. In case of a home delivery it is the parent's responsibility to have the birth registered and certificate obtained.

At times hospital/clinic staffs commit errors while submitting the parent's names in the birth details, to the Municipal Corporation. Sometimes these errors occur at the corporation office by clerks entering the details in their records. The end result is the birth certificate mentions the parents name incorrectly.

A birth certificate is an important legal document and any discrepancy in it should be corrected immediately. While it might appear inconsequential, but there are many problems that can arise due to the name of a parent being misspelt or wrongly mentioned in the birth certificate. Some of these are mentioned below –

  • Name of parent in your school records and your birth certificate will not tally
  • Your High-school certificate (which these days carries the name of both parents) will have the wrong name
  • When you apply for a passport, the spelling/name of your parent as mentioned in your birth certificate will be entered in the document
  • This will create problems if you migrate abroad and want to sponsor your parentsSince their name on their passport will have a different spelling from that mentioned in your passport you will not be able to prove they are your parents and sponsor them
  • In case of the unfortunate event of the parent passing away, you will find it difficult to prove your identity/relationship, and claim inheritance in the absence of nomination and/or will


The above are some scenarios where your parent's wrongly mentioned name in your birth certificate can create a problem.

Is it possible to amend my father's or mother's name in my birth certificate?

Though many people may suggest otherwise, it is actually possible to get an incorrect name amended in the birth certificate, provided you have documents to collaborate your claim.

You will need to submit the following documents to the Registrar of Births and Deaths in your Municipality –

  • Marriage certificate of your parents with their correct name mentioned on it
  • Hospital documents, such as discharge papers where the name of your parents and your date of birth is clearly mentioned


In addition to these proofs you will also need to provide the following –

  • An affidavit made on a Rs.100 Stamp Paper, duly attested by a Class I Magistrate
  • Copies of 'change of name' advertisement published in two local newspapers
  • Newspapers have a standard format for publishing change of name
  • You can also have the change of name published in the Government Press in your State. The same will then be published in the gazette, copies of which you will need to attach with your application
  • You will also need to fill in a requisite form (that can be collected from the Municipal office at a small fee) for correction of name

-  As per law , you can change/correct the birth certificate from the office of Registrar of Birth and Death.

- You should submit the following documents for the same:-

1. Your Marriage certificate , where the correct name mentioned.

2. Hospital documents, such as discharge papers where the name of your wife and date of birth is clearly mentioned. If birth on residence, then attatch an affidavit for the same .

3.Affidavit made on a Rs.100 Stamp Paper, duly attested by a Class I Magistrate.

4. Address proof , which shows that at the time of birth , parents were in the same jurisdiction.

You need to make application for change of mother name to sub registrar birth and death to get the name change. Provide copy of her other IDs of mother for change of name. 

If they refuse to change the name stating the reason that they have no provision for change of name then you need to file suit against sub registrar for change of mother name in civil court.

1. After marriage, the title of the girl gets changed as she adopts her husband's title.

 

2. While applying for passport, your wife should have applied in her after mariage name submitting the marriage certificate (or affidavit) evidencing that she has got her title changed after her marriage.

 

3. Ordinarily all her post marriage documents should have her title as that of her husband.

 

4. Apply for changing her name in her passport by submitting copy of an affidavit before the passport authorities affirming before a 1st class judicialo magistrate ng that her title has been changed to her husband's tityle after her marriage.

 

5. After her name in her passport is amended, there will be no problem in getting your daughter's passport.

It can be changed by an appropriate application to the concerned municipal corporation addressed to the registrar of births and deaths. The application shall be accompanied by appropriate enclosures supporting your claim of change in details. Apart from this you need to do certain things such as joint affidavit of parents on 100 rupee stamp paper attested by class I magistrate, copies of change in details advertisement published in two local newspapers (depending on the municipal corporation), photo ID of parents and educational documents of mother. It is advisable to contact a lawyer for the affidavit and the application

If the name has been erroneously entered or recorded by the staff of the authority issuing the birth certificate and you had actually applied with correct name, then you can get it rectified.

However if you had applied for the birth certificate with the name as reflected in the birth certificate then the authorities may decline to accept your request for change of name,.

In that case you may have to get an affidavit prepared and duly notarised stating that both the names are one and the same and that she is known by both the names.

This may solve the purpose.
