• I have filed 498a but still which all organisations can help me

Hello All, my husband and in-laws have abandoned me n my 10 months old kid. I have filed 498a on them but may I know can I file complaint in human rights commission , child welfare commission. Please guide me where else can I file complaints

In police station under women cell fir child custody on immediate basis. Otherwise case can be processed further in the court for child custody.

1. This is a typical marital dispute wherein involvement of Humans Rights Commission has nothing to do with pr the child commission.

2. So do not run after these organisations as you would get nothing from these.

3. Rather if you are an unemployed person then you can file a case under PWDV Act.

You can file a complaint under the provisions of protection of women from domestic violence act in Court against your husband and in laws.

Also, petition under section 125 CrPC can be filed in order to claim maintenance for yourself and your child if your husband is not paying any maintenance amount to you.

filing complaints in human Rights commission and child welfare commission would not be of any use, but still can be done.

you are advised to file a complaint under domestic violence act against your husband/inlaws for causing physical, mental, social and economic abuse to you and child,

you can also make a complaint to human rights/child welfare but that won't work as the FIR (498a) already lodged

HENCE THE APPLICANT HUMBLY PRAYS

  1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
  2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
  3. Pass orders u/s 18, in totality against Respondent1 to 3,
  4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
  5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
  6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
  7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
  8. That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.

- As per law , you have legal right to stay in your matrimonial home , and your husband/in-laws are under legal obligation to provide you residence .

- For getting shelter by your husband, you should file a criminal Petition under the provisions of Domestic Voilence Act.

- Further , for getting maintenance for your self and kid , you should file Petition under section 125 Crpc.

- Your husband is bound to provide maintenance as per law.Otherwise he will go behind the Bar.

- You will get nothing from the Human Right Commission or Child Welfare Commission.

- For getting justice , you should file the abovesaid mentioned cases.

Human rights commission , child welfare commission has no role in such cases until police connived with accused. You should file petition in court for claim of maintiancne and residence for you and child.

Application will file in court only for residence, protection, compensation, maintenance right.
