• Master plan - Road widening

Good evening, I have a land in Andhra pradesh, Tirupati. recently urban development authority announced a master plan in which road in my land got an additional 10 feet widening. I was planning to start some construction in my land. Now after the master plan I, applied for building plan, I am informed by some officials at TUDA that i had to gift 10 feet of road to free of cost only then they will approve my building plan otherwise they will reject the application. Then i raised the question of compensation they replied and I quote " when you come to us you don't get any compensation ". Please help regarding my legal course of action.

Hello, 

This is an arbitrary condition and illegal. 

You move an application and if they reject the same then move to HC for appropriate direction.

it Is better to give 10feet of. Land for road widening purposes 

 

you should get extra FSI for land given by you for road widening

 

if no compensation is being offered refuse to give land for road widening 

 

if your building plans are rejected file writ in HC against rejection of your building plan

File a writ petition in high court seeking directions to pay appropriate compensation for the portion of land embarked for road by TUDA. 

You are entitled to compensation.

You can also challenge the master plan but social needs shall get more importance than your personal needs.

Without compensation, land acquisition is illegal. And taking advantage of there dominant position, asking you to gift it which is equivalent gratification.

Don`t agree to it. Just apply in written and wait for their reply or get reply under RTI. For no action approach HC.

The only remedy which you have is to approach High Court by filing a writ petition and seek a direction to consider you construction permission application.

You should give the land for widening of road but not without compensation from the authorities.

If they refuse to approve your building plan without taking the land as gift.

you should file writ petition in High Court

You can fight against it legally.

If they acquire your land then they may have to pay the compensation as per law, their arrogance on the basis of the powers vested in them can be challenged in the court of law.

You can file a suit seeking direction to the authorities concerned to approve the plan without acquiring any land from you.
