• Epf transfer issue

Dear Sir,

My present employer has a exempted PF trust head quarter at Mumbai. I am posted at Chennai. I joined this organisation on March 2017. Despite of giving my UAN number which was already created by previous employer they created separate UAN also.

My previous employer had its PF registration in EPF office Roukela. They had opened two EPF accounts in Rourkela EPF office for two units in which I was posted.

I applied for transfer of EPF accumulation to present employers trust through my trust in December 2017 in hard copy in Form 13 since online transfer application to trusts was not available then. Simultaneously EPS application was sent to transfer the service to EPF office Mumbai.

Now it has been nearly two years my present trust says they have not received the transferred amount . I raised online grievance on epfigms portal then I got response from EPF Rourkela that the amount has been transferred. After that I raised an online RTI about not receiving the money by trust in October 2018, in response I got hard copy of Annexure K for one PF account with detail of Cheque sent to trust address. I sent the same to my trust. However till date they are insisting that the amount is not credited in trust account.
I again raised a online grievance in epfigms portal, then again I got response that amount has been already transferred for both the accounts also telling that "pursue your employer to send application about non receipt of amount.

On my request trust sent a letter about non receipt of the amount. I again raised a grievance attaching copy of trust's letter but again EPF office closed the case with " sanctioned amount endorsed to TRUST and amount debited on 04/05/2018. copy enclosed here with" however no attached document is available on website and e-mail received from office.

Also I do not know what happened to my EPS transfer.

Now I am worried about my money. Since both the offices are not giving any solution how to take up the matter. What are the legal options to get my money in account.

file complaint against DPF office to consumer forum 

 

2) in said complaint make your employer a party to the proceedings 

 

3) seek orders to direct EPF office to transfer PF money to PF trust 

 

4) also seek litigation costs and compensation for mental torture undergone by you

You can complaint to EPF office as well as file 406 IPC FIR against the offenders.

You may have to approach/address the top officer of the PF department with a legal notice by narrating all the events that had taken place chronologically and seek to redress your grievances.

If ther is no reply or any response, then you may drag them to the consumer forum for relief and remedy.

Alternately you may file a civil suit for recovery of accumulated amount but for that you may have to pay court fee to that extent that has been claimed.
