For Public Utility Govt. has power to acquire any land but in your case this does not attract so please file a case against this acquisition and till then don't accept any compensation otherwise you will loose your lien to get back the land.

Dear Sir,

The power of eminent domain allows the government to take private land for public purposes only if the government provides fair compensation to the property owner. The process through which the government acquires private property for public benefit is known as condemnation.

1.  Govt. can acquire "ANY" land for "Public Purposes", without consent of the land-owner /occupier, PROVIDED proper compensation is paid.

2.  The component of "public purposes" shall be pre-determined via a public project by the govt. authorities.

For acquisition due procedure has been follow, issue of notification, calculation of compensation, call for objection etc.

Govt. can acquire any land for public purpose by duly compensated to interested person/owner. Consent has no value except can object if acquisition not proper or compensation wrongly assessed.

Land acquisition in India is governed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Till 2013, land acquisition in India was governed by Land Acquisition Act of 1894

The Land Acquisition Act of 1894 allowed the government to acquire private lands. Under the 1894 Act, displaced people were only liable for monetary compensation linked with market value of the land in question.

The 2013 Act focuses on providing not only compensation to the land owners, but also extend rehabilitation and resettlement benefits to livelihood looser from the land, which shall be in addition to the minimum compensation

you will be notified before making an acquisition by a notice released by the land revenue department.

After that you will have  time to claim compensation as per latest land acquisition laws.
