• Pay fixation under FR 15(a)

Sir.. i joined in postal dept. in the year 1996 amd was promoted to inspector cadre in feb 2008. due to family problems i seek transfer to my loer post ie..postal asst. in the month of sep 2008. my higher authority accepted my request and i rejoined in my previous post of postal asst. can my pay be fixed as per fr 15a.

in case of transfer of a Government servant to a lower Gradė Pay under FR 15(a) on his own request, the pay in the Pay Band will be fixed at the stage equal to the pay in Pay Band drawn by him prior to his appointment against the lower post.

Yes, rule is very clear that the pay of a Government servant holding a post on regular basis will be fixed at a stage equal to the pay drawn by him in the higher grade.If no such stage is available, the pay will be fixed at the stage next below the pay drawn by him in the higher post and the difference may be granted as personal pay to be absorbed in future increment.

The referred memorandum states as below:

it was clarified vide the OM No. No. 13/9/2009-Estt (Pay-I) dated the
21 " October, 2009 that consequent upon implementation of the revised pay structure
comprising grade pays and running Pay Bands, w.e.f. 1.1.2006 in cases of appointment
of Government servants to posts carrying lower Grade Pay under FR 15(a) on their
own request, the pay in the pay band of the Government servant will be fixed at a stage
equal to the pay in the pay band drawn by him prior to his appointment against the
lower post. However, he will be granted grade pay of lower post. Further, in all cases,
he will continue to draw his increments based on his pay in the pay band +grade pay
(lower).

As per the above your pay  may be fixed accordingly.

The MACP Scheme for Central Civilian Clarification Government Employees is in supersession of earlier ACP Scheme . Under the MACP Scheme three financial Up-gradations are allowed on completion of 10, 20. 30 years of regular service, counted from the direct entry grade. The MACPS envisages merely  placement in the immediate next higher grade pay as given in Section I, Part -A of the first schedule of the CCS ( Revised Pay) Rules 2008, in case no I ( promotion has been earned by the employee 1 during this period.
