• Preferential transfer denied

Dear Sir, 
I am working in a bank and recently get promoted to scale 1.I was on maternity leave during the time I get promoted. I get a posting 170 kms away from my home. I requested my HR to kindly consider my request. My baby was only five month during that time. Later I get a regional transfer from my regional head and now I have 100 kms to my home from NY branch. I am not able to move my family including sick fatherinlaw(lost memory after stroke) and my kids. My elder one is 3.5 year and younger now 7 month. Nobody hear my request. They are saying me that either I can go for reversion or resignation. What to do. Due to lack of feeding my baby always get sick. Please help me

If you have some presidents that people have been transferred to their desired locations in recent times and your application has not been considered for this purpose writing the reason of bad health of your family member then you have to file a mandamus writ petition in the High Court in this regard but please make sure that you have the proper record to prove your case in High Court

You can file petition before CAT if your application for transfer is rejected

Finance Ministry has advised public sector banks to adopt preferential transfer policy for the women employees which aims at facilitating speedy transfers for female employees and make necessary provisions as far as possible, to place/transfer married female employees at the same place or the place nearest to where her husband is stationed.

You can file a petition to the District Concern Authority requesting to cancel the transfer order citing family reasons of your minon and at the same time send copy of the request letter to the Concern Authority.

Please don't take it otherwise because transfer in service is a routine matter so move only an application/request and wait only for three months if they don't do it then file a writ before the Hon'ble High Court for the relief and you will get it.

This is an internal affair of the bank and the manager concerned.

You make a representation in writing about this hardships you face and request  for a transfer to the nearest place  mentioning the difficulties you face while commuting to and fro to the work place and home.

You can give preference to your family  by sacrificing the latest promotion in case you are offered to a posting near your home if you do that.

Legal action may not fetch you fruitful result owing to the conditions prevailing in your side.
