• Government acquired land

Dear Sir
My quit ion is ; ones government acquired land and farmer go to court for compensatin and then court order to pay for compensation to the farmer/s and government deposit amount as per court order , but farmer not receive from court .in this case this compensatin(amounts) considered as a pay by government to the farmer on deposit day or when farmer receive it from the court .so whice day or date as as final payment date. Any suprimecourt judgement

Once govt deposits compensation amount in court as per court orders farmer is at liberty to withdraw the compensation amounts from court 

 

2)why has farmer not made application to court for withdrawal of money deposited in court

1. If the deposit is not given to the farmer even after raising the claim then the government is bound to pay interest to be calculated from the date when the award holder first raised the claim to get money.

2. So it is essential to know whether the award holder have applied for release of the money r not. If not then the government is not liable to pay any interest but is bound to release the money.

3. i am not sure why and how you are asking for SC decision when the issue is simple.

If the government deposits the amount in the court then the date of deposit of entie amount in the court will be considered as date of payment.

  1. As per the information mentioned in the present query, makes it clear that the amount is deposited in the court, but not yet received by you.
  2. The period would start from when you actually received it in your hand or account as depositing in the court is only the part of the proceedings.
  3. You should move an application for release of the amount before the concerned court and then court would direct the registry to release the same to you.
