• My employer not giving my relieving letter

I worked for a company for 1.5 years. while resigning they asked my to pay bond amount of 2.25 lakhs which i even paid. but even 45after leaving the company, they are not giving me my papers and now even threatening me. my new job is in risk and i want to sue my hr for unprofessional behaviour

Send email to your ex employer to issue you relieving letter 

 

2) mention that bond money was paid to them yet even after 45 days no relieving letter has been issued 

 

3) mention that you would lose your job for failure to furnish relieving letter 

 

4) if they refuse then sue them for failure to furnish relieving letter

In order to give detailed reply to your query, the Terms and Conditions of your appointment needs to be seen.

However, in case if you had complied with the same, you are entitled for the relief.

What about the bond amount of Rs.2.25 paid by you ? If it is paid under acknowledgement and through Bank you have better chance of success against your ex-employer.

You can invoke relevant provisions under Cr.P.C. and/or  IPC.

You can send a legal notice to get relieving letter as soon as possible and they can't take full bond amount from you only training cost should be charged as per Industrial Disputes Act.

 

Kindly send a notice from your email id to HR, operations manager and HOD of HR.

 

That stating all detail points from day one of resignation till date.

Go and join the new job. Your employment relationship has come to an end immediately upon submission of resignation by you.

File a suit for intentional delay in issuing relieving order alongwith a claim for compensation for loss and mental agony.

issue a legal notice and demand for Relieving 

letter with all associated benefits after settling

your account. 

If they refuse, you can lodge a complaint before

the local labour commissioner. 

You can also file a damage suit, claiming the

settlement amount and also the amount for

If your resignation has been accepted by the company then they are bound to issue a relieving letter, if not first you may issue a legal notice demanding the relieving letter and your other dues, if any, wait for a stipulated period and after that you may initiate legal steps on this.

  1. As per the information mentioned in the present query, makes it clear that you have been harassed by the HR and not been considered the fact that you have already cleared all dues.
  2. You should file suit before the civil court of law seeking direction for the giving of he documents held up with the company plus the compensation for mental trauma.
  3. And also you can file a separate police complaint against the HR specifically on the ground of mental torture and threat to life or threat to lose something (you will have to chose as to what HR threat can cause you).

Dear 

Send a legal notice to your ex employer for issuance of relieving letter. Mention that the bond amount has been paid to them and still they are delaying the letter due to which you have lost the job opportunity in your hand. 

Also claim for damage due to not issuing the relieving letter.

If still they doesnt issue the letter you should sue them in court for relieving letter as well as compensation for inconvenience caused due to act of HR.
