• Return of fees due to discontinue of course :bams

My son joined in BAMS course in the year Dec 2017 on Payment seat through Dr NTR university of health science. Andhra Pradesh As per university fees structure 3 Lakh per year. College staff offered me if I pay 12 Lakhs within six months for entire 5 years course they will give me discount of 3 Lakh. So I paid 10 lakhs fees in one go. Now after completion of 1 1/2 year course my son unable to study due to he felt in capable. In this situation I want to get partial refund from my bulk paid fees for five years after deducting period of study etc. What is judicial view in this case. Advice me to get balance uncovered period fees

1) what were terms of your selection to the course ?

 

2)is there a clause that in case you discontinue you would not get refund ?

 

3) the reason being if you discontinue studies seat in university would go waste

1. First check whether there is any system for refund of fees already paid.

2. Since your son is not going to complete his studies he can not get back the fess for the period he completed his studies but he is entitled to refund for the remaining fees.

3. Now if the college fails to repay the money then file a case before the consumer forum.

College is not wrong , why they refund the amount paid under the terms and conditions of the agreement but any how you have paid hard earned money , I suggest to file a Writ Before the Hon'ble High Court for refund on humanitarian ground otherwise college will not pay you any thing.

Dear Client,

Institutions will be allowed to collect advance fees for a semester or for up to one year instead of the entire duration.

In case of withdrawal of admission, institutions are liable to return between 50% and 100% of the amount, depending on when a student decides to vacate the seat. All returns by the institutions must be done within 15 days.

college would not refund balance amount as seat would go waste 

 

you have accepted to pay bulk fees of Rs 10 lakhs for 5 years 

 

you are entitled to TC no need to pay further Rs 2 lakhs

Have you written to the university seeking refund of partial fee after your son discontinued the studies and got TC?

If so what was the reply by them?

Do you have the reply in writing?

If the university id denying to repay the partial fee as claimed by you then you may file a writ petition before high court, let the court decide based on the rules and regulations.

Have you given the request for refund of partial fee in writing, if they did not accept the letter, then you may send the same by registered post and have an acknowledgement card secured.

After that you can approach high court with a writ petition.

  1. As per the information mentioned in the present query, makes it clear that you have been denied by the college which seems very unrealistic at heir end as when they can amend their so called oral rules to accept the payment in advance then why can’t they do the same in case of refund also.
  2. You might not have a Gaur case if they would have also not acted in asking advance fees, but now they are somewhere have put in their own trap of situation.
  3. You should approach the Hon’ble Civil Court of Law seeking refund of the fees and as you also have that signed paper with you.
