File a police complaint for cheating and fraud against the said person and approach the nearest police station. Since there was no agreement and hence the other party is liable to return the said amount of advance taken.

Sir, I am 30 year old women. I live in a rented house. My friend offer me to purchase a small plot which is on her father's name, in installment. I gave him 3 cheques of 21 thousand, 50 and 30 thousand (total one lakh one thousand as advance. After that somebody told me that the land was not registered land. Somebody gift that land on lease of my friend's grandfather and they have no legal document of the land. So I refuse to deal further ask my friend to refund my money. But they refuse to return my money and said that the token money can not refundable. I have not signed any deed or paper of this dealing.Now what I should do.

File a police complaint against the seller and further civil suit can also be filed for the recovery of the amount.
1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud, breach of trust etc.... against the person, supported with all relevant supporting documents.
2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.

The best option with you is that you can file a recovery suit. But, firstly you should send the legal notice to the person who took your money. maybe, on that note only he could return your hard-earned money.

If he is refusing to return the amount you may ask him to register the property to you, if he fails to agree you may lodge a crimninal complaint against him with the local police or issue a legal notice demanding your money for the said reasons.
After that you can plan filing a legal case for recovery of money.
