• Regarding cybercrime and defamation related law

I want to know if reposting people's picture that they put in public at fb is illegal. Also can I get sue if i make poster or bill out of someone's picture to expose them like with title "rapist" "Thief" Etc.
And if it is what if I cover their eyes or face like they do in tvs and such.

See you can be held under information and technology act and further in case if person is not identified from picture face is blured no case is possible then.

Yes. The picture is their copyright and legally you can not re publish it without their permission.

 

If you cover the face then there is no problem.

You may be prosecuted with defamation if not able to prove their guilt. Wild allegations without evidence - you will be held for defamation. And misusing/morphing pictures will book you under I T Act. At least don`t morph and cover their eyes or face, still can be identify by eyes or with content.  Certainly be sued.

If somebody has taken your pictures and morphed them then that is illegal and a criminal complaint should be filed.

For defamation a complaint should be filed before the court.

Posting someone's picture in social media or internet is not a cyber crime. But if you put some remarks or made some imputation concerning the person intending to harm that person will be a defamation except some given circumstances, against that person. 

Further posting someone's picture for commercial purposes is a civil wrong and you can be sued for the same.

  1. As per the information mentioned in the present query, makes it clear that the pictures are already in the public domain and then it was reposted.
  2. But, yes even if you have any proof to make some one guilty then also law doesn’t permit you to declare him or her as culprit except the court of law.
  3. So, I would suggest you to delete the post as of now and take the matter before the police and court of law to put him behind the bars.

If you post someone pic without his permission then you can be sued under copyright act.

And if you use captions like Rapist or thief then it is clear case of defamation and he can sue you for defamation and claim damages from you.

He can also file a criminal case against you for defamation.

If that person is really a home wrecker then aggrieved lady can lodge an FIR against that person.
