1) your mother should file declaratory suit that he is absolute owner of the house

2) that full consideration was paid by her

3) to direct her husband to execute sale deed in her favour

4) rely upon agreement executed by husband wherein he agreed to do so

Ask your mother to file complaint in the police station for mental harassment and torturing.

Plus the payment is made by your mother's account than that will be proof to show in the court and file case to transfer property on your mother's name.

Since the property is registered on his name alone your mother may not have any rights in this property even though she had financed for the purchase of this property and also she had been giving  money periodically to your father on the basis of this house property.

If he is demanding more and more money every now and then, let you mother mother decide to quit the place and start living a decent life without hos tortures in a separate place on a rented accommodation also so that she can be mentally free from all such tortures, besides she need not lose anymore money on the pretext of saving this property which do not legally belong to her

  1. As per the information mentioned in the present query, makes it clear that he has been doing the fraud with his own life long partner.
  2. This is very unfortunate today to listen this sort of things and that is also for some lakhs of rupees.
  3. You have the document to force him legally to transfer the same.
  4. In fact, all prior payments back in time would also support your mother’s case before the court of law.
  5. You should file a suit for enforcement of his words otherwise held him liable for damages in the form of money back with interest or property transfer on her name.

Dear Client

Your mother should immediately file a case of Domestic Violence against your father mentioning all the incidents.

In this she can claim compensation from your father and protection order to save your mother from emotional blackmail of father.

And your mother should transfer the house immediately on her name by help of GPA.
