• Can I request a copy of divorce decree without parents information on the decree?

Hello

I am looking to get a copy of my divorce decree but I dont want my father's name to show on the decree. I also dont want my spouse father's name to be shown on the decree. Is it possible to get a copy of the decree without names of our fathers on it? How can I obtain it?

1. Has the decree of divorce beeen granted by the Court?

 

2. While filing the divorce suit, did you mention both of your faher's name?

 

3. While pronouncing the decree, did the Judge mention both of your father's name?

 

4. Ordinarily, father's name of the parties are mentioned to specifically identify the persons since there might be multiple persons with the same name.

 

5. However, if the decree has not yet been typed, contact the Court Master/Peshkar to ensure that he arrangfes to get the decree of divorce typed without mentioning the father's name of the parties.

1) not necessary that your father name would be reflected in divorce decree 

 

2) your husband father name would be reflected on divorce decree

The aw takes it course and it does not matter to it what you want or what you do not want.

So in other words without these names no decree would granted by court.

See in India divorce decree shall have the name of fathers with the name of husband and wife, there is no procedure to request a seperate decree without parents name.

Copy of the decree will be as per the courts record and the names mentioned in divorce petition it can tell be changed afterwards

NOT POSSIBLE, moreover decree has already been granted and now you have to get the copy only, 

how can a copy be different from the original?

however, if you want to take a chance you can approach the Court for alteration in names in original decree but the relief, if granted, will come from the apex Court, means you have to fight till the apex Court

Sir you need to file an application for the certified copy of the decree in the Court.

Under the provisions under Law, you will get an exact and certified copy of the same in accordance with law.

Please don't take it otherwise but your demand is illegal.

If hypothetocally , any Prudent man in India sees a decree in the manner you wish , it shall be held as forged and fabricated decree document.

So you are advised to use untampered  genuine decree documents  for all purposes. It would be wrong on your part to use a decree document in the manner you have thought to.

Infact , the parents name indicate that it would be a genuine Indian decree Document.

You can request court registrar that you want copy of decree without father's name of both the party. You can show them a example of north American decree.

  1. As per the information mentioned in the present query, makes it clear that you don’t want parents name over the decree.
  2. In India, only parties name are there mentioned in the divorce decree.
  3. But, sometimes judges also mention about the father of each of the party, though there is no such rule for that but it happens from court to court.
  4. Still, you have the option to amend the decree by moving an application before the same court passed the decree stating the reason as so.

If you have not mentioned the names of your fathers and the Court has admitted the petition and heard the matter, then father's name may not be mentioned in the decree of divorce passed by the Court.
