You can file a suit for specific performance and get the said persons to get the property registered in this case from court order
1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud, breach of trust etc.... against the person, supported with all relevant supporting documents.
2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.
issue legal notice to legal heirs to execute registered sale deed in your father favour
2) if they refuse file suit for specific performance
Collect the death certificate of the seller and submit it to the registration office along with sale agreement. Registrar will do the registration in favour of the buyer.
Hello,
you may approach the court and file a suit.
please share the facts in detail for a concrete advise.
Regards
1. It the original owner has died then his legal heris are bound to complete the sale by making the sale deed.
2. SO his legal heirs are legally bound to register the sale deed and if they do not then you can file a suit for specific performance of contract.
3. Now this type of suit takes time and hence if you want to avoid running around the court then make some extra payment and get the sale deed registered.
Else door of court is always open to you.
yes I have Payment proof on 10 Rs. Stamp paper in 1995 .
Than your case is only evasion of stamp duty. For any dispute, you can file declaration suit. And sale deed registration will cost you penalty, 400 times.
File a suit before the court for declaration of ownership over the property showing the proof of payment.
If your father is having ther documentary evidence for having paid the entire sale consideration amount to the vendor then he can sue the legal heirs of the deceased vendor by filing a suit for specific performance of contract.
Consult a local advocate and proceed as per the suggestions received.
This can be an evidence for having paid the sale consideration amount, you may proceed with a suit for specific relief.
Dear
Do you have to possession of land and agreement of sale of land ??
If you have agreement of sale with proof of payment then you can get some relief.
But chances of getting relief from court are very low because of time which you have lost since 1995 due to limitation act you cannot sue the son's of seller. After 24 years.
