• My business partner is threatening me for my and my family life

He is just a director without having any shares of the company. He has made another company without letting me know and now they are trying to shift my company business and payments from my company to his company. after my involvement in the matter, they are leaving the company but they are asking for the entire upcoming payments from the clients for the worked we have done for. but I am not agreed on their terms as we have many of the liabilities are still pending to be paid like GST, Tax, and Penalties, etc. 
So, now they are threatening me for me and my family life, my social life, and for my professional life as well.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, threatening, fraud, breach of trust etc.... against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.

You should immediately file a complaint against of partners with police for the offence of criminal breach of trust, criminal conspiracy, cheating, fraud and criminal intimidation under section 406,120 b, 415, 420 and 506 of the Indian Penal Code.

 

If police does not take any action, complaint can be given to the senior officials of police under section 154(3) of the CRPC. However, if they also feel to take any action you can file a petition with the magistrate under section 156 (3) to a magistrate having jurisdiction to get FIR registered and investigation ordered against those persons.

A complaint can also be given to the economic offences wing (EOW), if the subject matter is more than Rupees 2 crore.

If they are threatening you with dire consequences you may collect the evidence and lodge a criminal complaint against them with the local police station.

If the local police are not cooperating then you may approach the top police officer with a similar complaint seeking his intervention and direction to the local police to initiate proper legal action on your complaint against your rivals.

Hello, 

If they are threatening you  then in that case you may go ahead and file a FIR against them for criminal intimidation under section 504 and 506 of iPC. 

If police refuses to lodge an FIR then file a case before the magistrate.
