• Succession certificate

On 7th we had judgement in district court and they ask us all our original birth certificate n other documents, on 8th may judgement was allowed in our favour and uploaded in the website it's 29 may and till now we din get the order copy. I m asking this as our lawyer is cheating us not appearing hearing it took us 15 months to get this please help what should we do .

You can make an application for issue of certified copy 

 

2) there is no bar to you making application for issue of certified copy if Lawyer is not cooperating

If your lawyer is not cooperating, hire another lawyer, he will arrange you certificate and certify copy of order. Or copy of order you can download from website and apply for certificate in court office. I think certificate provides free of cost.

See if order is passed and uploaded you need to apply for the certified copy of order if the lawyer is not cooperating you can personally go and apply.

For all original documents you need to file an application before court the court will allow same and you will able to collect the documents. This may take a weeks or more time.

In one day, originals cannot be release from court. Have to file application in court to release your originals and replace them with copy of it. As of now, go to court and apply for certify copy of originals on urgent basis.

Will get by evening or tomorrow morning, Application files till 12 AM if court is not of morning.

1.  You can yourself apply to the court for return of all original documents, via a proper court fee stamp affixed application.

2.  The help for the above can be taken from writers /typists sitting inside and outside the court premises.  Even a freelance lawyer would help you in this.

You can ask for the certified copy of the order from the court but applying to it.  If your lawyer is not co-operating you can get the same

Certified copies are generally issued within 4 to 5 days.

Don't forget to mention the mode as urgent if you want to get them urgently. That will probably cost you little more, but it is not much.

Since you say that the judgment had been uploaded in the website, you may download the same from website and take a printout of the same, signature of the same is not required.

Or if you need a certified copy then you may approach the office of the court and apply for a certified copy as a party in person, you dont require the assistance of your advocate on this.

You just make an enquiry with the staff of the court on the procedures for this and comply with the same accordingly.

It may hardly take one week to 10 days to get the certified copy of the judgment once you apply for it, hence you better appraoch the court office directly to have the first hand information about the procedures to be followed in this regard.

You can inform the authorities that the originals are held in the court, it will take time to retrieve them from court, hence you are producing the photocopies of the same and you will produce them immediately before the authorities for verification sooner you get them from court an d to bear with you until then.

And after judgement court take time to issue the succession certificate and it depends on the officer of court when he will sign the certificate an order to issue the certificate.

  2. He should asked for the order dasti on the same day of judgment, where you would have received the copy of the same on the day itself.
  3. Now, even if you happen to file a request for urgent certified copy then that would also take 3 days minimum.
  4. You can inform to the interview panel about court proceedings and request for some time to submit the originals as soon as possible.
