Hi Sir/Madam, I am Devesh Pandey, I bought a 2BHK flat in 2017 from a builder. My flat is situated in Greater Noida West. Last few month back, I have noticed some Seepage in bedroom walls. That time I acknowledged to my Builder but he was not responding. Now last month in rainy weather I noticed water leakage from roof. My flat is top floor. I want suggestion what should I do. please complaint to the society and if no steps are taken by the society then please approach the cooperative court making the society as a party.

Send legal notice to builder for poor construction and calling him to repair such leakage in case builder fails you can can file consumer complaint against the builder for repair and seeking compensation.
You can send a notice to builder to repair it. Else you can also file consumer complaint against builder
1) If the you have kept balance payment of builder that you can hold until the work is completed.
2) Secondly, check builder has handed over the building to society, if not you have to make in writing complete to builder and than in consumer forum if he does not complete the work.
Issue notice to builder about poor construction and damage. Ask for repair cost or get it repaid. If ignored, file consumer complaint. And also prepare through some contractor/architect a report of material used and factual condition.
Send a legal to the builder calling upon him to immediately fix this. Incase he fails to do the needful despite your legal notice, appriapp consumer court/RERA.
Is there an association formed in your apartments?
If so have you made a complaint about this in the apartment?
If there is no association formed yet, did you make a complaint in writing about this to the builder?
If not do it immediately and send the complaint by registered post.
Wait for few days and then issue a legal notice to him about this and demand rectification immediately, then you can proceed legally if he is not doing anything to make it alright, because this is construction defect.
1. Who is maintaining the project? Unless builder is the one who is maintaining the project, it will be very difficult for you to prove deficiency of service on the part of builder after 2 years of purchase if there is water seepage from the roof.
2. You can file a complaint case under Section 12 of CP Act and seek an inspection report to be prepared by a structural engineer to prove that material used on roof is not standard.
