Dear Sir/Madam
I'm 65 years old pensioner with disabled wife holding British passport and OCI card. All our life worked in UK only and never worked or earned any money in India.
We arrived in India on 30 Sep18 and were booked to go back to UK on 24 Oct 18 but could not due wife illness. Now we have stayed over 183 days and not sure when we can travel as wife is seriously ill due dementia, do I need to have PAN card or not? What steps do I need to take in order to avoid any issue at the airport or do I need to do nothing since I have not earned any money in India? We have been coming at regular intervals in the past but for app 3 to 4 weeks only. Prior to this visit we came to India in 2016 Aug for four weeks. We own a small apartment in joint names since 2009.

for sale of property in India you need to obtain PAN card

Hello 

 

If you were not having any earning during this time then it is not mandatory for you to get a PAN card in India. 

Make sure that you do have a valid visa at the time of leaving the company.

What if I am a foreign citizen? Can I apply for a PAN card?

If you are a foreign citizen and you want to run a business or invest in India, you should also apply for a PAN card. Foreign nationals undergo the same procedure as Indian nationals when it comes to obtaining PAN. The only difference is that the application of a foreign citizen should be filled using Form 49AA, which is especially intended for foreign citizens. The completely filled-out form should be submitted to an authorized PAN Service Centre through the foreign applicant’s authorized representative based in India.

Currently, PAN Service Centres are only located in India but foreign PAN applicants can apply online. The online facility allows foreign applicants to pay their fees using their credit card, but only if they have India-based credit cards.

Since PAN is also available to foreign nationals, this document cannot be used as proof of Indian citizenship.

PAN will require for the purpose of submit IT return, which can also be substituted by filling form 16.

PIO card holder is required to register with local authorities for any stay longer than 180 days in India on any single visit, while OCI is exempted from registration with local authorities for any length of stay in India.

You can apply pan card online. 

Since OCI holders are still foreigners and not Indian citizens, you need to apply for a PAN card using the PAN application form applicable to foreigners.

PAN would not be required as you had no earnings during your period of stay in India.

Since you have no earnings in India you don't have to file any returns in India and you don't need any PAN card.  Further there won't be any issue at airport.

THough in case you sell the apartment you will be needing the PAN card.
