• Circle inspector threatening to stop the govt survey

Sir, the total extent of the land is 4 acres in which 3 belongs to jain and 1acre belong to Mr. Maharshi both of them bought land from Mr sham. I went into an development agreement with maharshi for 1acre land recently I applied for govt survey , surveyor came on site and instructed us to clean the land to conduct survey in this process she also issued notice to neighbouring land owners. We have cleaned the land and places a development board the very next day circle inspector called us to police station and threatened us not to enter the land without even checking the document which is a clear title. When we questioned give us a reason what's wrong In cleaning the land for survey he threated saying " I will put you Mro and surveyor everyone behind the bars if you go on the land" and also said go get a bail for yourself I will file a case. He sounded one sided which is illegal , we are thinking to file a complaint to CP is that the right way or any better strong way of approach please suggest

Hi,

You are suggested to verify the land title and if it is correct, file the complaint against that Circle Inspector regarding said illegal activities to SSP, DIG and DGP. Also file complaint in court and get an injunction order against CI and police.

File complaint against inspector with commissioner of police 

 

2) if no action is taken file RTI application as to what action has been taken on your complaint 

 

3) you can seek court orders restraining him from creating obstacles in carrying out survey of land

You can file a complaint against the said officer with commissioner of police and the concerned SP if not action is taken from there side approach high court to police commissioner to take appropriate direction against such officer.

2. If you have title deed in support of your ownership in respect of this land then do lodge complaint with the CP in writing.

3. Yes, do file a civil suit for declaration and injunction. File such suit immediately after the court reopens.

1.  File written application before the district collector, against the circle office, and request for hearing in the matter.

2. The circle officer will be called for his statement and things would get clearer on the same. Filing complaint before Police is of no use till above proceedings are conducted.

The act of the circle inspector is illegal, he cannot interfere in the civil matter.

But what to do, they may go a little more beyond their authority or limits for the sake of consideration received from the concerned party.

You may give a complaint against him either with his higher officer or with a the state human rights commission for his atrocities.

You should file written complaint against the circle inspector to the higher officials of police asking them to take action against him for going ultra wires and doing things which is not supposed to do as per his duties.

 

Also, a suit for injunction should be filed in order to restrain the circle inspector from disturbing your peaceful possession of the land in any manner whatsoever.
