Dear Client,

To your horror, after father`s death, all three will inherit 1/3rd share in total assets of father. Well, he can claim through court but haves no money, so can`t do anything. If next time he quarrels with mother, call the police.

If he harassing his mother and sister, they should approach Police and float a complaint against this boy.

Under no circumstances he has the liberty of manhandling her sister and mother. If he wants his share, he should prefer a suit in the District Court and not create ruckus at home

If he is torturing them then they can lodge a criminal complaint agaisnt him with the police.

Legally speaking he is entitled to a legitimate share out of his father's property if his father was reported to have died intestate.

But his tortures on daily basis demanding money for his luxurious life cannot be tolerated  hence his mother can divide the property and give him his share, let him do whatever he likes, after that they should not allow him to come to them for anything.

They can file a suit for partition and injunction against him if he is not agreeing for an amicable partition.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like harassment & intimidation, against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.
