See I my view this name is already registered to other company or Firm same can raise dispute and legal suit so search for unique then same can be registered as proprietorship and you can convert to partnership firm or company and can do all business.
Dear Sir,
It is ok. You can start your business under the above name in your sole proprietorship name and later can change it into partnership
there are already companies carrying on business in name and style of evergreen india . it would un necessary cause confusion in business . use some other name for carrying on business
Yes you can but if he said name has trademark registration then you can't use the same for the same business
Thank you for your response. How can I check if a name is available or not for business registration
See you can search online and you can engage service of CA or advocate for search and register the Firm.
You just go to the official IP India website, input the name of your company and the trademark class, and if no company has registered trademark evergreen india then you can apply for registration
2) sthe entire database on the MCA in a single search. Find out availability of your company, LLP and OPC name right away..
A name is generally ok and the firm has to be registered. A proprietorship firm should be made and the trademark should be obtained for it. In case it has been registered you wont get a trademark on this name.
Regards
If you apply for trademark then you will come to know if the same has been used by any one earlier or you will be allowed to use it as your own trademark.
Your choice is different to that of applying for the trademark with the chosen name.
