• Need suggestions on how to proceed with construction work after dispute

I hired a building contractor on 2017 for construction of first floor (individual house) . On March 2018 construction started and till December 2018 brick work was also not completed, even after paying scheduled amount well before. Now they are demanding more amount and there is a dispute. Have paid 73% till now but outer plastering work is also not completed. Can you please let me know if i can file a complaint and continue with my building construction using other worker or i shouldn't construct till complain is resolved.

you can issue notice and can give them some time if in time they fail to compete file a complaint agaisnt contractor seeking refund and compensation and can proceed with other contractor.

It is necessary to peruse contract signed by you with building contractor 

 

2) if contractor has failed to complete work within stipulated period terminate the contract and sue the contractor for damages

This is clearly a case which comes in deficiency of service under Consumer Protection Act. You can issue legal notice to him by engaging advocate and if he doesn't complete work than file a consumer complaint in which you can ask for refund of money and compensation.
The case also comes under Specific Relief Act.

First give him a notice if you have written contract otherwise no need and start your work, he will go to the Labour Department definitely so notice is necessary for the purpose giving full facts of his negligence.

If the contractor has violated the agreement conditions and not fulfilled the obligation then you can terminate his services and engage a new contractor for completing the construction.

You can issue a legal notice to the previous contractor asking for damages and also can drag him to consumer forum for claiming compensation against him
